Had our walk thru tonight and it didn't go well.....
So one of our major issues during the inspection was that squirrels had gotten into the attic and there was poop every where up there.....so in our contract it states that the attic must be free of squirrel droppings and the hole must be sealed.......well we go into the attic tonight and there is sh$t everywhere including all the instulation and the hole was patched by putting a plastic cap over it and then stapleing a mesh wire on the inside. This is totally unacceptable and I refuse to close until money is put in escrow for us to hire someone to do it right plus I also want to be credited for the extra month rent I will have to pay to stay in my apartment because I refuse to move in when people will be pulling insulation out of the attic which you access through my bedroom......so my questions are.......Who do you even hire for this and how much should be left in escrow for this......also if the seller refuses to do this which I'm assuming he will because he has been nothing but difficult thus far......can we really walk away.

First of all, I'm sorry you're going through this. What does your lawyer say? I've never experienced this, but I am assuming if they refuse to fix a problem that you had stated in the contract needs to be fixed that they will have to make financial amends so that you can get it fixed. Do you get the feeling that they will want to walk away? I would think that at this point they just want to have the house sold, and hopefully they'll agree to a reasonable solution.

If you are going to hire someone yourself I would get estimates--three of them and have the seller give you a credit at closing because holding escrow can get hairy. the seller's attorney will hold the money and then inspections have to be done before it can be released and it just ends everything by receiving the credit so that you can do the work yourself if that is the stage you are up to. I am not sure who to get the estimates from but it might be two different services (1) a contractor to repair the hole and (2) a removal company or clean up company. Speak to your lawyer as well. I completely agree. We have our walk through in a week or two, and this is what I'm worried about...things not being done and working when they should.
