Forgery statue of limitations - help my divorce!

Sorry under a fake name here. I discovered today that my ex opened a checking account and overdraft account in my name in May 2004, then proceeded to forge my name again Jan 2005 making it a joint account (even had a friend bank officer notarize it). He then overdrew the account and the overdraft account ran up to $10K plus interest. In an effort to hide it from me he continued to make payments on the account until June 2009. He even switched the address on the account to his best friend's house so that I wouldn't find out.

So, lawyer LIF members....do I have a case for criminal charges? We're still mid-divorce and I would love to hand this over his head for leverage. From what I can see on the web the statue of limitations is 5 or 6 years from the last date of activity which would mean June 2009, not May 2004 when he opened it, right? HELP! I need a victory on this one!

The good news is I have proof!

I am not a lawyer, but since he continued to use the account after he opened it, I believe you don't have to worry about statute of limitations.

I'm not a lawyer, but...

I think it all depends on what state you're in and whether you wish to pursue civil or criminal charges.

I'd suggest you contact an attorney

I'm pretty sure the statue runs from the time of discovery. Honestly, I'd skip getting an attorney & head down to the police department to file charges.

From what I've read he'll be brought up on federal charges.

As for the guy that notarized your signature illegally, he's in for a sh1tload of trouble as well.

Thanks ladies. I finally feel like I have a little control in this divorce. I hope to talk to my attorney tomorrow to confirm and see how we can use this to our advantage.

I'd def report this to the police and the lawyers. charges should def be brought up on him for this. and alert the credit bureau as well.
