For the ladies with no maternity leave...

What is your plan?
I wantt to take at least 8 weeks- does disability pay decently? Is there a standard percentage?

From what I hear, disability pays crap but I'll be signing up for it because $140 per week is better than $0 per week.

I have enough vacation and sick time accrued to get about 3-4 weeks of my full pay and I guess I'll be collecting disability simultaneously, which is only for 6 weeks unless I have a c-section, which will give me 8 weeks. Either way, we've put money aside to get us through. I'm taking the full 12 weeks that I get through FMLA.

My job has this supplemental insurance as a rider on the dental, but I do not have insurance here- actually, no needing it was part of my negotiation for my salary. That disability covers 60% of your salary.
So I guess my options are to ask if I can sign up for that extra insurance (which will only cost my boss $10.00 per month), or ask them to lay me off so I can collect unemployment.

eta- this crapass place screwed me on my vacation and sick time, and doesn't have to adhere to FMLA.

My HR guy said that NYS Disability is about $160 a week. I'm planning on taking 8 weeks (I'll get 6 paid through disability for a natural birth or 8 for a c-section). We added up what I would get on disability and subtracted it from what I would make in 2 months at my job and we made sure we saved at least the difference.

Also disability doesn't kick in right away. My sister said there is a couple of week lag, so I'll still be receiving checks even after I go back to work.

I could use my vacation and sick time, but I'm probably going to be coming back to work in March and that will leave me with no time for the whole rest of the year.

We have the same situation it sounds like.
I dropped hints to my boos that maybe he could do me a favor and lay me off instead of collecting a crappy $170/week. He's mulling it over.....Chat Icon

I will be in a similar situation I think. I am UNSURE whether I will get paid time off. I am actually the first employee they have to be having a baby.......so this is new to them. And since we have a small company, less then 30 full timers, I don;t believe I get the FMLA stuff.

I only have 2 weeks of vacation & 1 week sick time.

When I tell them, I will ask what will happen so I can plan accordingly.

This does seem like the best option. But am I going to have to go into the unemployment office weekly with a newborn?
Or tsage job interviews? How do you get out of the whole- looking for a job requirement?

With unemployment you get a max of $450 a week, after taxes that is $365. So far they have not asked me if I am looking for a job.

It is $405, and that's great that they haven't asked you about looking for a job, I was trying to figure out how I would handle that....

I'll have accumulated 3-4 weeks with my vacation, sick, and personal days combined, so I'm going to use that. For the remaining 4 weeks I plan on staying home, I'll be working from home...taking on 50% of my workload and getting paid 50% of my salary. I'm not crazy about the idea, but we really need the money.

Yeah I have been luck so far. I do claim 1 day a week every few weeks to show for the personal training I do.

I tried to sign up for my job's additional insurance too, but they told me since I was pregnant and had been to the Dr. already to confirm that I was pregnant I would not be eligible for coverage Chat Icon Chat Icon

Just because your employer does not have leave, does not qualify you for unemployment. You need to be actually unemployed.

Just because your employer does not have leave, does not qualify you for unemployment. You need to be actually unemployed.




Yeah, your boss would have to agree to fire you and then, hopefully, rehire you.
I work for a very small company, directly for the owner, so I am hoping....

Because I make salary and comission, my rate is only $312/week.

I went on the unemployment website and this is what I came up with to get my figure....

Q: How is my weekly benefit rate determined?

A: Your original benefit rate is calculated on your actual high quarter wages. Your rate is one twenty-sixth (1/26) of the high quarter wages paid to you in your base period, except if your claim began before January 3, 2000 or your high quarter wages are $3575 or less, then your weekly benefit rate is one twenty-fifth (1/25) of your high quarter wages. Wages are applied to the quarter in which they are paid. The current maximum rate is $405.

If your claim is effective April 17, 2000 or later, you have an additional option to have your benefit rate calculated using weeks worked and wages paid to you in your base period. Refer to your Claimant Information Book to see if you qualify for this option. You must finalize your choice of base period and establish a final quarterly rate before you can request your rate based on average weekly wage. If your rate is calculated using this option, the total weeks and wages will show on the bottom of the Monetary Determination mailed to you.

Your entitlement and benefit rate are initially established using the information that your employers have reported to the New York State Wage Reporting system. You will be sent an initial Monetary Determination based on the information in the Wage Reporting system. You will also be sent a Request for Reconsideration form with the Monetary Determination. If you disagree with the Monetary Determination, your should complete the Request for Reconsideration form and submit it with proof of your employment and wages to the address given on the form. Your initial Monetary Determination will be reviewed based on the proof you submit. If necessary, your base period employer(s) will be contacted to verify the wages paid to you in your base period. If your benefit rate changes, a revised Monetary Determination will be issued to you. If the review results in no change to your benefit rate and your rate is less than the maximum rate of $405, your Request for Reconsideration will be processed for a hearing.

It is important to keep pay stubs and other proof of wages paid to you in your base period so that you can provide an accurate estimate. Wages include the monetary value of tips, bonuses, meals and lodging, as well as commissions and vacation pay.

Your weekly benefit payment is reduced by one-quarter for each day you work or are ineligible due to unavailability or incapability to work or other reasons. If you earn over $405 in any week, regardless of the number of days worked, no benefits can be paid for that week.

not too sure, but I took my on paper salary and divided it by 4, then took 1/26 of it to get the check amount. Hopefully it's correct, and it seems to be.

And I would opt to not have taxes taken out and worry about it when tax time rolls around. We usually get a very nice refund, so a little less wouldn't hurt when we would rather have the little extra when I am not working...

I got fired when I was 38 weeks pregnant and I got unemployment until I went back to work when DS was exactly 5 months old. I got $370/week. It is the easiest thing in the world, you file online and it is direct deposited into your bank account.

It was the best thing that ever happened to me. I was only supposed to get the 6 weeks disability and then I would have had to go back to my awful old job. They decided to terminate me and it was great for me.

I was on NYS disability and it was $132 a week after taxes.

You dont have to go to unemployment, it can all be done over the phone...
