Do you have to take FMLA?
I have job protection through my union. I have saved up 12 weeks vacation/sick time, will be getting a supplemental check from STD, reciving NYS STD and union STD.
I'd rather save the FMLA if I really need it, but not sure if it is something you have to do...

Re: Do you have to take FMLA?
I'd check with your HR and Union Rep on that- the answer will vary by company and also according to what your contract has set

Usually, FMLA will run concurrently with any leave you are taking, but like the PP said, you would have to check with your company policy and union contract. Also, I would double check that you can receive NYS Disability and Union Disability while you are being paid in full from sick/vaca time. Your contract could be different, but in my experience usually you cannot be paid STD while being paid your full salary from another source.

Re: Do you have to take FMLA?
FMLA provides job protection. So if you are out for 12 weeks you are protected under FMLA law as long as your company meets the standards for it. It's not a matter of taking it or not.

As pp said check on all of those disability payments too. I have STD through my job but I get the max from NYS so they substract the NYS from what my STD through work pays, its not extra.
