Bride sues florist

OK I can see suing for the amount of the flowers, but $400???
And wow what kind of flowers was she getting for $27K????

And as an aside, why does Newsday always have typos in their articles?

NYC bride sues florist, saying wedding flowers were wrong color
8:30 AM EDT, October 16, 2007

NEW YORK (AP) _ The wedding was lovely, except for the flowers: They were the wrong color.

So says the bride, Elana Glatt, who was so miffed at the florist that she filed a lawsuit alleging breach of contract.

She says Posy Floral Design on East 72nd Street substituted pastel pink and green hydrangeas for the dark rust and green ones she had specified for 22 centerpieces.

Not only that, the lawsuit, which was filed Friday in state Supreme Court in Manhattan, alleges that the hydrangeas were wilted and brown, and arranged in dusty vases without enough water.

The lawsuit says the offenses caused "extreme disappointment, distress and embarrassment."

"The use of predominantly pastel centerpieces had a significant impact on the look of the room and was entirely inconsistent with the vision the plaintiffs had bargained for," Glatt, a lawyer, said in the lawsuit, filed on behalf of herself, her husband, David, and her mother-in-law, Tobi Glatt, who paid for the flowers.

They flowers cost $27,435.14. The lawsuit asks for more than $400,000 in restitution and damages.

Stamos Arakas, the florist, said that he and his wife, Paula, tried to match the color of the hydrangeas with a picture Glatt had given them, but explained to her that the colors might not look the same. He said he had many satisfied customers.

"My father used to tell me, 'Don't deal with the lawyers," Arakas said. "Maybe he was right, God bless his soul."

If I spent that kind of money on flowers, they better be what I ordered. Pink & rust are not even in the same color group.

$400k in damages is a bit much though.

This woman gives real lawyers such a bad name. Chat Icon

I have to say, though, the reason she stated $400,000 in damages is b/c, once the complaint is filed, you can't raise your damages request so easily -- but what you get (IF successful) is generally much, much less than you ask for. It's a common practice, but still... $400k in damages? Get over yourself and your wedding.

If the wrong flower were THAT distressing to you on your wedding day, then I think you have some mental instability issues with which you should deal.

Re: Bride sues florist

27,000 for hydrangea centerpieces?? that seems insane...I do understand suing for reimbursement for the flowers being the wrong color...but not the 400,000...

I agree. If she paid $27k just for flowers, I can only imagine how much she spent on the other stuff.

Re: Bride sues florist

If I spent that amount of money and walked into my ballroom and seen centerpieces that looked nothing like I asked for, I would have experienced some serious pain and suffering too. The lawsuit seems a little frivolous, I wonder if she attempted to get her money back first, but this is the land of the lawsuit, so it's really not that surprising. I spent a fraction of that amount and had extremely high expectations, but luckily was completely satisfied. I wonder if this bride did her research?

Honestly, if I were paying that much for flowers, I expect perfection. I would sue to if the flowers weren't what I had ordered.

Re: Bride sues florist

She will never get the 400K because harm was not afflicted by the flowers. Whether they were the wrong color or not she can only sue for the amount she paid the florist. Unless the flowers attacked her...which I doubt. She can sue for damages or specific performance.
