Re: Breaking a contract with a contractor questions
Have you mentioned to your current contractor if they don't get the job started you will find another contractor? Maybe they will make you a priority.
Also does your current contractor have money already to do the additional work or did you just pay them to pour the concrete thus far?
I would think since they haven't delivered and they aren't waiting for inspections you should be able to walk away.

I was going to say this.
They may "magically" have an opening when you threaten to find someone else.
When you read through your contract is there any fine print about them being able to get out of their promise to complete the job in 6-8 weeks from starting point?

Re: Breaking a contract with a contractor questions
I did threaten this and was ready to do it when we went from start date of March to July. Then, they did pour the concrete that next week. So now it's poured - a slab in my yard, my kids can't play out there b/c it's dangerous, and they say they are backed up and not starting til sometime in August. I'm just so sick of fighting with them every step of the way. We assumed once the concrete was poured they would be building ASAP - not letting it sitting there for over a month before they do anything.

Re: Breaking a contract with a contractor questions
Just stop paying them and tell them you are finding someone else.
But even someone else coming in it will probably take longer than 6-8 weeks after you factor in delays for inspections, weather, etc.

Stop paying the other contractor, write a letter tell him his services are no longer needed.
Hire the new contractor, by the time August rolls around and the old contractor comes by to work, it will all be done.

Re: Breaking a contract with a contractor questions
I called and told them I was switching and they have now promised Aug. 1 start date. Later than I want, but probably, realistically sooner and easier than the aggravation of switching at this point.
they start!!

Re: Breaking a contract with a contractor questions
I will say one thing... if you switch contractors it is likely that you may have to have your permits re-filed, or at least amended.
Call Town of Hempstead and ask them before you make any definite decisions on this.
