ARGH!! --*UPDATE*

There is not enough space here to write about our home selling/buying experience. We've been at this for close to 3 years and we have hit every freaking snag you could imagine. We finally are all set ... closing on our sale on Friday morning and on our buy Friday afternoon. Until I just picked up the phone...

My lawyer called to say that the woman we are buying from wants to stay in the house for 10 days after the close and not the 5 days that was discussed.

I am beyond p*$$*d. We have been jerked around by our buyers and finally have that all straightened out and NOW, 2 days before closing, she wants to stay longer! We had a contractor lined up to start remodeling our kitchen on July 1st - start date of course has come and gone.

And... we negotiated signed contracts for this house back in MARCH and chose to close after the school year to accomodate HER!

My answer is F NO!

My lawyer was trying to cool me down by saying we will get decent rent for the 5 extra days - I don't freaking care about the money - I want to get on with our lives!

Sorry so long winded. Needed to vent.

And please don't quote - I'll take down when I cool off. Who knows? Maybe she is an LIF'er

So our lawyer told her lawyer "no, she cannot have the 5 days." And supposedly she wasn't happy. And, we were told, she would give us the keys 5 days after closing at 5pm.

Closing was on Friday - couldn't have gone smoother. Everyone was polite and joking around. But I heard her lawyer explaining to her about the post possession penalty of $250 per day and something told me that she wasn't going to hand over the keys on Wednesday at 5pm. And I kept telling my husband that she's not getting out on Wednesday. But he was more optimistic - he called the contractor to start work on Friday.

Low and behold, our lawyer got an e-mail from her lawyer at 9:30 last night (monday) saying SHE WAS TAKING THE EXTRA 5 DAYS!! Basically it was a big F*** You to us - we told her no last week but she's taking it anyway. And.... as we've been told... there's really nothing we can do about it.

I am beyond pi$$ed!

Why can't believe do what they say they are going to do? Anytime we were asked to go along with something we said yes - until this request - and we still have to freaking go along with it.

I am beginning to not like this house. I didn't think everything was going to go smooth but this is ridiculous. Chat Icon

I woudl say no at this point too. Or I'd charge her an arm and leg to stay. Say it will cost you money to change movers/contractors etc.

Is there anything in the contract? I know we had to be out by a certain date or else we had to pay the homeowners $150 a day.

I have to read it again but my lawyer mentioned she would have to pay $250 a day. I don't care about the money - I want her out!

sorry you're going through this. It sucks, it really does. I had the same issue except that it was her stuff. She took a week to move it out of there and then had the nerve to leave tons of trash.

That update stinks and I am so sorry you are in that situation.

Are you sure there is absolutely nothing you can do? It is now YOUR house...can't you get the police involved?

I would have the contractors come on Friday regardless of her being in the house. She sucks!

Our lawyer said we cannot due anything until the 5 days are up and then we could start eviction proceedings but chances are she would be out before that gets off the ground.

I just wanted to start getting excited, KWIM? This has been such a long tedious process and everytime I think we are close to the end - the end gets pushed out. Chat Icon

Why can't you start eviction proceedings when the initial 5 days are up?

You didn't agree for her to stay the additional 5 days, right? What does your contract say? How does she get the additional 5 days even though you didn't agree to it?

ETA: NM, read that wrong. You can't start eviction until the INITIAL 5 days are up, correct?

I'd be majorly peeved at this point.

can you call the contractor and explain the situation and see if you guys can start the work on Friday anyway? Show up to the house with the contractor and say that you had this scheduled, she was told she needed to be out of the house and if she insists on being there she'll have to just deal with whatever work is being done (not sure what kind of work you're doing, so have no idea if this would even work or not)
