May be a stupid question but... is there anything legally you have to do before getting it up on the web?

It depends on what you are doing. Is it a service? Are you selling something you made? Are you reselling product? It's always best to speak to a lawyer.

I started an online business. I had a legit business certificate and all the paperwork done before had. Other than that I dont hink there is anything you actually need to do to go online.

Where do you get a business certificate and what type of paperwork are you talking about? I appreciate the info and you can FM me if you want instead.

You have to go to the County Center (I went to Riverhead) and get a business certificate- which you get by filling out the appropriate paperwork- whether its for a sole proprietorship or a partnership or whatever...
Then you can get a business checking account if you want to but you don't have to. I also got an EIN # and a NYS Sales Tax ID (I do craft fairs and sell in person besides just selling online).

i'm so glad i read this thread. i'm looking to sell the same "type" of items. i'll check/investigate what's here in nj.
i think the same would apply in fl.

sorry, forgot to include my original answer/reply.
as far as your taxes are concerned (i used to work for h&r block), you really don't need anything to get you started. if it's just yourself doing this and not a partnership, YOU are the business and you would just file a SCHEDULE C.
but like i stated in my previous reply, i'm going to investigate here in nj and see if it's also needed in fl.

Are you using the website only to advertise? or are you somehow providing services through the website?? Will your services be provided to people in other states?
If its strictly services in NY, you dont have to do anything if you are operating under your name.
However, you must file an Assumed Name Certificate (also known as a "dba" or "doing business as") with the clerk of the county/ies in which the business is conducted ONLY IF you are operating under a name other than the proprietor's (yours/your SSN) (no formation document is required).

Because it is an online business, file in the county you live in (but you only need to do this if its going to be a d/b/a)
eta: you don't need an EIN, you don't need to incorporate or anything fancy like that....any income generated or expenses incurred would be reported on your personal income tax return (Schedule C) same as if you received a 1099 if your familiar w/the way that works.
