I don't know if B has shared with you but I am having a little problem with S at school. His behavior at lunch and recess was "so bad" that the principal asked if I would take him home for lunch. Obviously this causes a scheduling conflict in my day. I drop him off at 8:30 then pick him up at 12 then drop him at 1 then pick him up at 2:35. Each time, I have to fight with my daughter to put on her coat etc. Besides, I really can't do anything significant with her, like take her to the Children's museum because by the time I get there, it will be time to leave to pick up S. Anyway, we found out that it really isn't legal to ask the parent to do it and I gave her a letter today stating that this practice will cease after the Thanksgiving break. The principal would not agree and told me that we need to meet and work out a compromise. I feel that they are discriminating against S because of his ADHD. (we are in the process of trying to find a drug that works better to control his symptoms). So I am feeling drained because I am not sure if I am going to have to hire an attorney and sue the district. ARrRRRRRRRRRRgh.

As a teacher it is absolutely illegal for the school to ask the mother to take the child home for lunch!!!!
I am APPALLED!

Every school district and school is mandated to provide the least restrictive environment for each child with a learning or physical disability.

I would mention though that maybe the parent and administration might need to find another more suitable placement (ie special ed classroom with aides and such) so that everyone gets what they want

It's illegal for them to make you pick up your child from school for recess because of behavior problems. The child should have an IEP with an ADHD diagnosis and accomodations should be made for the child to participate in every single school day activity. She needs to fight that and call a meeting.

LRE and a special ed classroom because a child is having problems on recess wouldn't fly with me personally. Perhaps an aide on recess would work though.

She just told me that her son does NOT have an IEP, he was declassified at the end of last year. However, she went to sign the papers today for him to be evaluated and hopefully have an IEP by January. He was declassified because he was doing better on medication but he grew this past summer and the meds are not working as well as they used to. She is hoping to get a "paraprofessional" to be in the classroom with him and possibly an aide at lunch.

I mean...I was a teacher for several years in the city. The things we dealt with on a daily basis were INSANE. And we NEVER required a parent to pick up their child for lunch because we couldn't "handle it". I mean...this is just disgusting to me, and nevermind discriminatory.

It IS pretty disgusting! I hope it all works out for her Chat Icon I know through my own battles and trying to get a para for my son that it's a rough road but tell her to remember that she has to be an advocate for her child because no one else will be Chat Icon

I would contact the Superintendant of the District immediately and request a CSE Meeting. By law, they need to give the parents one within 30 days ... sooner under certain circumstances. This child should have a clear IEP in place so that issues like this can't and don't happen. Hugs for the parents ...

Did your district have full day K or half day and you pay for the extended day?

Why didn't the school suggest a meeting to work WITH the parent to help the child get the medical attention (you said he was doing much better w/his meds and they now had to be adjusted ??) as well as the additional assistance he needs - rather than demanding she take him home for lunch/recess every day - ?? -

Aside from his mother being 'inconvenienved' and stressed over it - think about how that makes that poor kid feel !!! Chat Icon

This is a Public School.

And she DOES work...she is an RN!! PLUS working on her Master's Degree. I swear...I don't know how she does it. Chat Icon

i wouldn't jump on the lawyer bandwagon yet. there are several areas to cover before she needs to spend money. a lawyer should be a last case scenario

she needs to contact the school psychologist and set up a team meeting. if the child doesn't have an IEP, she needs to start the process rolling to get him one if he needs it.

regarding going home at lunch, while i don't know if it's illegal, it's not being handled properly. the mom should tell them she is NOT doing it anymore and she should work with them to figure out a plan for her child. what exactly is he doing at recess that he can't be there? is he hitting other children, running away, etc? if it's behavioral, the school behavioral consultant should get involved. if he is making a dangerous situation for himself or others, he may have to miss recess or have it somewhere else, but he shouldn't have to go home. (i am assuming that's what it is, if it's not, that's another story!)

either way, the CSE/IEP process needs to get started. whatever testing needs to be done should be started ASAP.

As a school psychologist, I find this appalling!

Does her son have an IEP? If not, the first thing will be to get the ball rolling on the evaluation process for special education. The school psychologist should do a Functional Behavior Assessment (FBA) to get a better idea about the triggers for his behavior.

With an IEP, he will hopefully be able to get the supports he needs to successfully make it through the school day. A child with ADHD can be classified as "Other Health Impaired". If lunch is the only time of the day that he has difficulty, then maybe he would be able to get a 1:1 para to be his shadow at lunch and provide him with support.

There are many routes that can be explored, but the school is responsible for providing each student with the supports they need. Your friend should not be removing him from school for lunch.

ETA: I just read more of the thread and saw that your friend already started the IEP process. She's taking the appropriate steps!

well, I'm not nearly as qualified as the teachers, lawyers, and psychologists responding....

but it just doesn't sound right to me either. I've never heard of a parent having to babysit her child during lunch.... that's a very unorthodox request of the school. I bet the district is hoping she isn't an informed of her legal rights as a parent so they can continue burdening her.

she definitely deserves better.... she also sounds like a supermom. I can't imagine doing all of that continually Chat Icon
