Do you think Target should pay up?
I think the guy who hit the thing should be liable. The whole thing is rather comical though. Imagine having to tell your insurance company that story?

It really is the driver of the pick up trucks fault. It should be treated as a hit and run since they can't find him. She's still covered under insurance

This exactly! I once was in a small accident. I was pulling into a small parking lot. Already stopped and behind a guy's pick up truck. The guy in the pickup didn't pull in bc there was a huge truck in the lot taking up spaces bc they were dropping off an ATM at the bank. Since the parking in front was blocked the guy decided to reverse and then pull into the side lot. Problem is he reversed back crashing into my car behind him. He pulled in the spot and walked away. When I confronted him he said it wasn't his fault bc the guys in the big truck told him to go back and park elsewhere so I should go after them. Well, the final outcome was the pickup truck driver had to pay. THe guys in the big truck totally helped me as witnesses and said the pickup guy just reversed on his own.

But will she be required to pay a deductible even if she's not at fault? Since they can't ID the pickup I'm wondering if she'd be stuck with that and no one to reimburse.
It's a drop in the bucket to target, they should help get out since mossy likely it wasn't well secured. They're lucky no one got hurt with that thing rolling around and a kid even climbing on it afterward!

I don't think Target is liable. The guy who hit the ball and caused it to roll away, thus causing damages, is 100% responsible.

I agree...I never understood the point of those huge heavy balls anyway. They are SO lucky that child didn't get hurt that was playing on it unsecured!

Interesting. How does it work in a multi car crash/fender bender type accident? Is only the original person held liable? I *thought* it was directly linked to the car that actually hit you and then those people's insurance company can go directly after the original source. In that case, I think Target should pay for it and then they try and go after this pick up truck.
I could be wrong though. Sucks.

The pick up truck is definitely 100% at fault NOT Target.
A pick up truck is about 3 tons. I am sure the crash is what made it unsecure not faulty installation.

Well, it sucks but sometimes that's life. Target doesn't appear to have any responsibility in this. It was secured and not an imminent danger until the person in the pickup hit it. You can't just make Target responsible if they really had no culpability just because you want someone to pay for the damage.

No-her insurance should cover it and she'll be out her deductible.
Although, I could see the insurance company going after Target as it was their ball and their parking lot. But I don't think it will make any difference in the woman's coverage.

I would think target is somewhat liable. Onviously it's not securely put down for it to be knocked into and roll away so easily. That could have a hit a person and done a lot more damage. i could be wrong but it didn't look like the pick up hit it that hard. More of a side swipe. And is a car door really $3500 worth of damage. I mean I'm no expert on that it just seemed a little high

I would think her insurance would pay due to it being classified a hit and run. The guy who hit the ball must have known he hit it and should have stopped. He is liable for any resulting damages, in my lay person's mind, not Target.

This is a hit and run. Her insurance should cover it. Unfortunately, she would be out the deductible. If there was evidence that the ball was not secure and target knew that before the accident then target should pay.

During a windy day in a target parking lot a shopping cart hit the grill of my sisters car. Target covered the damage.
So even though someone left their cart out loose in the lot, ( Side note: cannot stand when people do this ) Target covered the damages.
I think that it happened in their parking lot, it's their property (the ball) , they should pay her ded. Personally I think $3,500 may be a bit much but car guy prob heard target and jacked up price

To me the shopping cart is different and I can see Target a liable. They have people who move the shopping carts, they maintain their lot. I can see how this can be partially the fault of target.
A structure being loosened by a vehicle and negligent driver is not their fault. Now if target does pay for it thats nice of them but not their fault.
