well it's been 2 weeks

and the sellers lawyer still has not sent the contract. stay away from Barbara e Hoppmann as an attorney. she is really going to be the reason we do not get this house.

So sorry! What do the agents say? Is there any explanation for this? Or plan for how to move it forward? Or is everyone just sitting around held hostage by this attorney? That's ridiculous, there are other options, unless the seller wants the attorney to hold the contracts.

Honestly, I feel there is more to this... If it was really just the sellers attorney not being responsive -- which is extremely unprofessional! -- I think the seller would have moved on. If, as a listing agent, I learned that a sellers attorney had not only failed to generate a contract in two weeks, but had also not returned any calls, I would be on the phone with that attorney, and probably advising my seller client to go with someone else or risk losing the deal!

To me, the seller has ultimate responsibility as the client. The attorney should be following his or her directions, and if not, the seller has to take control and find another attorney if need be.

So, speaking as an attorney and a real estate agent, if you don't get the house, I'd say it was the seller's fault (with listing agent also sharing some blame).

What is your attorney and your agent advising?

I hope it works out, but good communication is the key to any successful real estate transaction. I hope your advocates are at least communicating with you and advising you!

I have no clue what is going on. my attorney has made several phone calls and emails and she just does not respond. we found out that she was disbarred then reinstated in 2002 for reasons very similar to this. the sellers agent state that he is pushing them to get another attorney. we will wait until tomorrow then we are walking away. cause this is getting ridiculous.
eta: my attorney and agent are both advising us to walk

from what I understand the seller is an elderly man now in a nursing home and his children are the ones in charge so maybe that has something to do with it.

With this piece of info, it could be that the kids are in dispute.

I responded to your other thread that a similar thing ended up happening to us with the sellers deciding to take the house off the market after we shelled out the cash for the inspection, and it ended up being a blessing in disguise.

FTR, that house was an elderly woman too and the daughter I don't think was ready to sell.

We are going to see another house about 2 blocks away from this one this afternoon. hopefully it goes well. what I don't understand is that their lawyer emailed my lawyer and said that contracts were on there way and then nothing came.

Shady. RUN, don't walk. Nothing good will come of this - and I promise you it will get worse down the road even if the contracts come. This not the house for you even though you may not see it.

I speak from experience. I was in a TERRIBLE ordeal last year that dragged on for close to a year, and I'm still in disbelief over what the seller and their attorney tried to do. We finally were able to get out of it and found a much better home, for less money, in a better area.
