Maternity leave Agreement/No FMLA
Hello All,
I am currently a FTWM and my company has less than 50 employees, so we don't have FMLA. So I am very concerned about keeping my job and I am due in April w/ DC2.
So, can anyone share their Maternity Leave Agreement that you have used or plan to use? or any past experiences?
I wanted to consider also working from home a few weeks after the baby is born, because I don't know how I will be able to afford not to work as well as show my company that I am a dedicated employee.
Any thoughts & advice are welcomed.

Maternity leave Agreement/No FMLA
How has it worked out for other folks? At my previous company, we had less than 50, but they did follow what FMLA allowed. Can you come up with an agreement with them? Some places might need you to come back earlier, like after 6 or 8 weeks. Don't forget, you will be on disability for that time. You can't lose your job if you're out on disability. That is completely separate from FMLA.

I'm the 1st person at this company to go on maternity leave. So I'm like the guinea pig.. They want me to come up with an agreement , but I curious to see what other pp have done. I also say company doesn't offer short term diaability

i think its great that they want you to come up with an agreement.
i would tell them you would like to follow the FMLA guidelines (and outline them if they need you to) and see if they agree to that. tell them you would be willing to work from home a few hours a week (after week 2 or 3 whatever you decide).
if they say no to that proposal, ask what they find reasonable.

Disability is through NY state whether they have a seperate policy or not. I would set it up like FMLA. You are eligible up to 12 weeks leave. 6 or 8 weeks depending on vaginal or cesarean birth are covered by NYS. Also put something in the document about nursing, even if you don't plan to nurse.

My company allows up to 12 weeks maternity leave which is covered by fmla.
You get paid by short term disability for only 6 weeks and it pays total sh*t but its better than nothing at all.
We are also allowed to use our sick bank time to get full paychecks once the 6 weeks runs out. But thats up to the individual to use. Most aave those for when they return or if they need to take a leave of absense.

Thanks for your reaponse. Could you please advise how I could get disability thru New York State.?

Sorry, I don't have that information. My hr dept took care of my disability payments. Maybe call the dept of workers compensation and see if they can direct you to the correct place.

When I had my ds I didnt work at my place of employment for a year yet so I was not eligible. I had a c section so I got 8 weeks disability which they made $170.00 a week. My HR women gave me the information to sign up. Then I toke 4 weeks personal leave. It was unpaid because I didnt have any time left but they approved it.
