should i be annoyed?

so dh and i recently got a puppy, and we decided to finish fencing in our backyard.

right now, we have 3 sides of our yard fenced in piece meal between our 5 neighbors

in order to finish fencing things in, we're installing a 6 foot white pvc fence on the front of our property with a driveway gate, and we're also fencing in one full side with a 6 foot white pvc privacy fence

we told our neighbor who this affects on friday that we were going to be doing this, because we needed to chop down some bushes that they planted on our property before we owned our house...they also had a few pipes that we thought may be an issue because they too were on our property

we gave them the option of having the fence company take down their 2 old mish mosh fences and replacing them with the new one, or having us put our fence up right next to theirs. we never asked them for any money or anything. they told us that they would be happy with us replacing the 2 existing fences.

come today, the husband shows up to our door with a typed "agreement" that he wanted us to sign

it included the following:

*we're responsible for any plumbing or electric that is damaged as a result of installation
*we're responsible for any damage to the fence, even if it is a result of his son kicking his soccer ball repeatedly into the fence
*they have a pool, and if that section of the fence is damaged for any reason we are responsible for immediate replacement
*the fence is on "their" property line

there is also no time frame listed on the contract

needless to say, we refused to sign the "agreement" and informed them that instead of replacing their fence we would instead put ours up directly adjacent to theirs, entirely on our property

are we wrong to be annoyed?

i'm just baffled by this-it's 200+ feet of fence on our joint property line that we're having installed...

I would be annoyed too and DH even moreso, since you guys are doing them a favor.

He sounds like a loon.

I would also not sign that agreement.

I wouldn't sign. The only part of the agreement that I agree with is that you would be responsible for any electric or plumbing that got damaged as a result of installation b/c that makes sense to me. Everything else is just crazy, especially the part that if there is any damage on their side as a result of their son kicking his ball at it, that you would be the one to fix it. That sounds crazy to me.

You should totally be annoyed. I would get the town involved reagrding the property line. Whatever is on your property is "your property" and I would hold true to that.
That guy sounds nuts!

I can see if you damaged anything of theirs, fine. The rest, tough shit, their kid breaks it, they fix it.

As for the pool issue, Im sure you would do that anyway, so its just ridiculous.

I think its best, like you said, to tell them forget it and you'll just keep it entirely on your property.

Um. Yeah. Don't sign. You are doing exactly the right thing by leaving their fence and putting YOUR fence on YOUR property.

did you get your land surveyed?
if im reading it right and their old mish mosh fence isnt on your property I would put your new fence up next to their fence. If they decide to take it down its up to them.
Their kid can play soccer against their own fence.
take pictures and try to avoid them for a while.

That's crazy. We were putting up a new fence and when we approached our back neighbor about it, they agreed to pay for 1/2 of the cost for that side, which would be replacing an old broken down wooden fence - so they were thrilled. We signed a "fence agreement" with them, that basically says we are all equally responsible for replacing any damage, unless one party causes the damage, then they will pay.

I still wouldn't take their word for that.

Who's to say they don't already have some kind of issue on their property but are looking to get a freebie.

It just totally raises a red flag for me.

this is kind of what we're thinking-200+ft is a lot of room for something to already be damaged

also, since we bought the house from a family member of theirs, we're pretty sure they may have run illegal plumbing/electric on our property anyways

IF something were to happen to a random electric wire, that is on our property, i can't see how we're responsible for that-it's our property

and the existing fence is EXACTLY on the property line, with the exception of one portion in the back that is very much so on ours-that section of fence is being removed regardless now bc it's on our property

I wouldn't sign that in a million years.

I'd fence in on my property and leave his fence as-is. If you lose 2 inches here or there, so be it. Well worth not dealing with his antics. Your only obligation is to face the "nice" side towards him.

And if he damages your fence because his child is kicking a ball against it, he sure as hell is responsible for fixing it. Esp if the fence is entirely on your property.

the saga continues-the fence guys showed up today, and based on the most recent survey of our house, on of their fences is 7 inches on our property-so if we were to put ours 2-3 inches off of that, we would be losing almost a foot of our property, over 200+feet.

that fence is now being removed.

grrrr.

oh boy. Good Luck. Hopefully he doens't give you a hard time and want to do his own survey.

It's amazing what putting up a fence can do to neighbors.

We had issues at our old house. He was a lunatic!

Why would they have electric and plumbing lines on your property? I'd be making them take taht crap out now. How can you be positive that they're not somehow tapped into your lines?

And they should have their fence on their property. I would just make sure that ALL of it is documented (pics of the property line and their fence, etc) so that they can't come back and say you destroyed their property

Do NOT sign and do NOT bother with them ever again. Just put your fence up and make VERY sure it's on your property line.Did you have a survey done to be sure where your property was?

He "let" you have the property? Then it's yours. Whatever the survey says goes. And if he is being aggressive or you feel unsafe, call the police.

What a douche! How can he let you have what's already yours? Just make sure everything is done per the Survey. People are effing nuts!

Even though you're losing 200sq ft if you put a seperate fence it sounds like you'd save yourself a lot of headache. The neighbor sounds like he's going to be your new "best friend."

Just out of curiosity, when you purchased your home did you have a survey done then?
