How easy is it to back out of a contract if
My lawyer wrote something into the contract saying the pool will be open and in good working order, and the gutters will be fixed and the basement will be dry (we were told be 2 an engineer and an architect they believed it leaked in one spot because their gutter was broken there for a year and nobody fixed it) for the walk through. Were supposed to close next week and the pool is still not open. Im not even sure about anything else b/c I just stopped by and looked one day.
Im so nervous to wait all the way to the walk through (right before the kids and I are going back to school) for these things to be done. I hate waiting until the last minute. What happens if theyre not fixed? I really do not want to buy a home with a crappy pool. I have one now and have had a major problem with it.
Will it be easy to back out and get my down payment back if I am not satisfied?

My guess is that if things are not specified they would try to come up with a monetary compromise

i agree with PP that they'd probably try to take money off of the price you agreed on. but i don't think you have to accept - i think if it's in the contract, you should be able to back out.
I'd speak with your attorney though since i'm just guessing

I think there should b money in escrow to correct those things. I'm not sure I'd back out because of th pool not bein open though. Check th our lawyer....

normally i would agree but it really depends on why it's not open ... if it's because of some sort of damage (eg: they can't fill it because of a huge crack or something) then that could take a lot of money to fix, and the price quotes they get may not even be enough to cover the real cost. i would possibly back out of the contract if that were the case (unless i was guaranteed to get the full amount i pay for the repair)

If they refuse to open the pool, the only monetary compensation i would agree to is a complete re-install of a new pool.

You can't get out of a contract for those reasons. They probably don't want to open the pool until the last minute so that they don't have to clean it. Your contract says that the pool has to be in good working order (not one that is necessarily your personal style). I would be surprised if they didn't resolve the other issues.
