Are High Hat Enclosures Illegal
One of LIPA certified contractors installed them in my house last year and I have had no problems. A guy who I work with says they are illegal which he learned in home inspection school. If they are why would LIPA give rebates on them?

They cover your high hats in the ceiling, some provide fire protection and some are energy efficient.

Do you mean a box enclosure surrounding the light fixture inside of your duct work behind the ceiling? I can see where that would be a fire hazard.

I know there are two types of high hat installations when DH did ours, depending on whether or not insulation is present around them or not. I don't know that they are "illegal", maybe just referring to the correct usage of the right type in the given situation?

Most locations require recessed lighting that is installed into an insulated ceiling to be a IC rated fixture enclosure, and in some areas it is required to be an air-tight or AT type enclosure for energy efficiency purposes.
There are heat factors with regard to proximity of insulation materials and in some cases it is necessary to install a barrier or a recessed light that has a box enclosure around the recessed light can. Sometimes this is referred to as a Boot Box and an inspector may require this if the recessed light fixtures are not an IC type enclosure.

You are correct.. there are 2 different type of fixtures. those that are rated to touch insulation and those that are not. If the type use is NOT rated to be touching insulation then you would most likely be required to install the enclosure you are talking about.
