Major Vent LONG
I don't even know where to begin...
We are closing Tuesday and were told we were getting keys at closing.
Some background: We found our house in October and our offer was accepted within a few days of seeing the house. The sellers told us that they wanted to move quickly! We went into contract in November but we have already put a rider on the contract once, giving sellers an extra month. The new contract had an on or about closing date for Feb. 28th.
The house the sellers are buying apparently had some issues with CO's but they never told their attorney this (I think it is a friend of their mother's). About 2 weeks ago we get wind of this when we tried to schedule an appointment to see the house to measure for a couch. Our attorney told us that they we had to put pressure on them b/c we were being too easy going and they were taking advantage. At this point we were nearing 5 months of dealing with this sale.
Unfortunately the seller's mom, who was also their realtor, got sick with cancer in November, and passed away mid March. When we heard this we told our attorney to give them time to settle family matters but that we were not willing to let our mortgage rate expire and to go much further than our contract expiration.
Last week we get a call from our attorney stating that their attorney said that the CO's were taken care of and we would close April 3rd, six days after the last possible contractual day. We were fine with this b/c we just wanted to get this over with. I called the attorney a few days later to make sure they were giving us keys and that I could go ahead and schedule movers.
Fast forward to yesterday.... DH calls the sellers to schedule the walk through and learns that the sellers are not going to be ready to leave. Were they planning on ever letting us know this??? They do not know when they will be out. Contractually they have up to 5 days after closing to be out. They know that they have to pay our mortgage and everything else in this time. I cannot believe that they waited till yesterday to tell us this!!! We already scheduled everything around our closing date (moving company, fencing, cleaning, vacation days, and all utilities). I am fuming right now. I feel like we have been taken advantage of.
We have a toddler so painting and moving is going to be tough. My parents have graciously offered to take vacation to help us move, paint and watch DS. Now with the date changes we have no help. The sellers cannot give us a date that they will have the place vacant.
I'm not looking for any answers, just needed to get this off my chest. I'm trying to now figure out when we should move. We have some major painting to do. I know it will be much easier with an empty house. I also know it is going to take DH forever to paint the house alone, while I watch DS.

Is it only up to them to decide the closing date? I don't know how it works but if it's scheduled for the 3rd in writing how can they change that?

The real estate contract allows them 5 days after closing. It doesn't happen often but it did happen to us.

Ok so you're still closing the 3rd for sure but they have til the 8th to get out? That stinks but not sure what you can do.

I am so sorry you are going through this. We went through something similar for our first house and our apt lease was ending so we were screwed. After that mess, I made it super expensive for the sellers to stay beyond the 5 days at the second house we bought. They thought I was crazy with the contract, but then didn't leave until 11pm on day 5 so.... Good luck getting in. I don't understand why sellers just don't move! It's so hard to plan for buyers....

That stinks....I know in our contract with our buyers...if we are not out they can charge us up to $150 a day of still being there. This is my motivation of moving out. Im sorry..this must be frustrating

After the five days it gets super expensive for them! I just wish they could have been courteous and given us a head's up. I wouldn't have spent hours scheduling if I had known. I found out yesterday that a bunch of my family members are all meeting at our new house on Easter and we are having a big painting party. We'll be dining on paper plates! I'm just so thankful to my family and friends that have offered help. I know it will all work out in the end, it has been so stressful though.
