Disability vs. FMLA

If I haven't been employed with my company a year can I still get disability but they just won't hold my job for m bc I am not covered under FMLA?

I want to quit after the baby anyway so it may not even be worth the hassle. WWYD?

Im pretty sure you can, I dont think one has anything to do with the other. I work for a small employer (only 2-3 employees) so shes not required to hold my job however, she does offer short term disability

That is right. My job is the same, so I assume it is the standard. They aren't required to hold the job beyond 6/8 weeks (depending on type of delivery) if you haven't been there one year.

FMLA is 12 weeks.

FMLA is 12 weeks.



Yes, and you are eligible for disability for 6 weeks after a vaginal birth and 8 weeks after a c-section. FMLA is what allows you to take off the extra time beyond disability.

Many people do this. From what I understand, technically, you have been working so you are entitled to it. Leave as if "you are coming back" but once you are gone and disability ends you simply say I thought I could swing the child care but its too much money and youre going to stay home instead. They may see through it. If you hope to return in the future then I'm not sure its the best wway to leave but if you don't plan to return ever - it really doesn't matter. I think disability is only $170 a week unless your company has some sort of plan with it (for example mine uses sick days with disability and I end up getting paid full 6 weeks/8 weeks if C, and then for FMLA remainder is unpaid unless I use vacation time)

Short term disability and how much youll get a werk depends on your company and what youve contributed to it. My company offers 2 plans 1 you dont cobtribute anythng to it out of your pretax $ and 1 you do. You need to find out from HR what your company offers...
