Inspection and soil test results
Inspection done: - Old termite damage, inspector said repairs weren't done properly but the owner has since installed a full treatment. - Roof has 3 layers, only 2 are allowed to be up to code, roof also has 2 leaks.
Soil test: - came back positive and was reported to the county.
Is the realtor and sellers obligated to divulge this information to potential future buyers when showing the house and accepting offers?

I can't believe anyone would agree to a soil test - u know how much they will have to pay now?
I don't think they legally are required to report anything, that's why you get inspections.
Are you still buying this house?

Ugh, I'm sorry this is so stressful and so much sh!t is going on
Question: how did you know the house had an underground oil tank? Were you told by the listing agent?

Yeah, the sellers realtor let us know it was underground. Basically, if the house heats with oil (which you can find out from the listing) and you don't see it in the basement or outside then yeah, it's underground.

I cant see why any lawyer would encourage their client to get a soil test???????? Unless they agreed to it without consulting an attorney. It could cost 100,000 or so to clean it up....must be reported to the EPA, etc. This is not a light issue we are talking about. I am so surprised they even agreed to it.
And didnt you just post down below they accepted another offer?

Not sure if they consulted with their attorney but unfortunately, or fortunately, that's not my problem. And yes, at least that's what their lawyer said today. We're not sure if it's true or not.
I'm just curious if the realtor HAS to tell any other potential buyers about the results of this test. It was already reported to the DEC. And our mortgage guy said that this info should come up on the title report, but I'm not too sure how that works.

Wouldn't the county already be aware of the test? I am pretty sure they have to disclose that.
I wonder if their new offer is an "as is" offer.
