Seriously?? Realtors what do you make of this?

I was browsing houses earlier and came across a house for a great price and this is in the description:

Pie shape lot on cul-de-sac. Short Sale opportunity with challenges. Tenant occupied without Sellers permission. Buyer will be responsible to evict tenant after closing.

What???

(this is in FL by the way)

We looked at several houses like this, the owners had tenants, and legally, they could not kick them out of the house. If we had entertained the thought of buying the house, we would have had to spend time and money going to court to get them to leave.

For some reason, you can just squat in a house legally.

It is a tough situation! We actually have a listing like this in my office. HUGE house that was in diamond condition. Probably worth in the $600K to $700K range but on the market for $399K.

The catch is that it's a short sale and there is a tenant in there that needs to be evicted.

So basically, a buyer has to buy the property sight unseen (as to the interior) as the tenant obviously is not cooperating, and then take on the hassle of evicting them. But it is a great value for the property.

I think with these types of scenarios, you are looking to attract an investor rather than your typical buyer who is buying a home for themselves as a primary residence.

Eviciting a tenant is not impossible. You just need to have a lot of cash on hand since you obviously won't be getting in there anytime soon.

I think they are being upfront. If you really want the house I would also factor in how much time and money it will cost you to have the tenant evicted. Also the tenant may destroy the property so you might have to deal with that issue as well. If you love the house, and sadly may need to gut everything, and can deal with a LONG eviction process then I would look, but I would get the facts before making an offer. I don't know Florida eviction laws. Perhaps an attorney well versed in this matter there can advise you properly. It may end up being something you don't want to get involved with but I would get professional opinions about the matter before proceeding.

Yea there are TONS of other houses, I wouldn't get involved in that. Just thought it was crazy that someone can live in someone else's house when they don't have "permission". Plus, they can trash the house in the meantime and the buyer would be responsible... no way!
