Do you get your keys the day of the closing??
Our lawyer said we do not get possession of the house because our closing is at 2:00 and it needs to go to the town blah blah blah Does that mean we won't get the keys?? Has anyone dealt with this before?
ETA: My DH spoke to the lawyer so I am not sure exactly what he said, he didn't say we wouldn't get the keys, my DH is assuming. My real estate agent said that isn't how it works and he would call the attorney.

that doesnt sound right. we closed at 3pm and got the keys right there and spent the night in the house that night. unless its weird town ordinances or something? where are you buying?

Yes we got our keys at closing. I think it should say in your contract when you get keys/possession of the home.

We didnt get the keys the day of closing...but it wasn't because of the town, it was because the sellers still had to close on their house.
Seems weird to me though.

it has nothing to do with the town. It just depends on whether or not the sellers have vacated.
house 1 - keys at closing. Seller had already moved out.
house 2 - keys at closing BUT the seller was still in the process of moving that day, and it took way longer than they anticipated. They didn't leave the house until 11pm, so we didn't actually get into the house until the next day.
and because of that, our buyer did not get the keys to our house until 2 days after closing (we closed the same day on both).

We had to wait till the following week since they were still not closed on their other house. Not a big deal for us though..

We didn't get our keys because we did a dry closing - I guess the money hadn't fully gone through so we had to wait until the next day to get keys...

We got our keys right at the end of the closing... and we went directly to the house after to celebrate... Seller was already all moved out... If seller is paying your rent for a few days bc they need the extra time, than that would be the reason why you wouldnt get the keys...

We did with the first house but with the new house our contract says they have 3 days to give us the keys after closing.

It's not uncommon for the sellers to retain possession of the property after the closing BUT that would be negotiated and known in advance. I mean, sometimes the seller can't move out by the date of the closing, in which case money is held in escrow (to protect the buyer from any damage to the property that might occur when the seller is occupying it), and the seller will pay the buyer a set amount of money (per day) to remain in the house that is no longer owned by the seller.
If the seller is not remaining in possession of the house for a period of time after closing (which again, would have been discussed and negotiated), then you should be getting the keys at the closing.
Maybe you just mixed up what your attorney was trying to say, but I would just go to the source and ask your attorney to clarify what he meant!

welcome to nesconset! we bought here 2 years ago and i love it!
we didnt get out keys until 3 days after closing but we had previously agreed to that with the sellers. it was right before thanksgiving and they needed time to repaint their new house before the holiday and we were happy to accommodate them bc we didnt plan on moving in right away anyway.
i think unless you had previously agreed to something there is no reason you shouldnt get the keys right away.
