maternity leave
how many weeks/months pregnant were u (or plan to be) when discussing maternity plans w/ boss? I am having such an issue, the annoying office manager keeps arguing w/ me that I do not get disablity "just for having a baby" as she puts it..... and she is like God to my boss............... anyway, i refuse to argue and my last response was for her to call NY state labor law dept (as i did) and how they were so uphauled that the office manager is telling me no............. meanwhile our disability ins. carrier also told me yes and faxed me all the info......... but i honestly do not feel like debating w. the office manager so gonna sit down w/ boss when ready.................
its a small co and i am the 1st to get preg,,, lucky me! i am 7 months preg........ about time to do it?

oh i know! but i learned after being at this job for 7 years, EVERYTHING is an issue and debate..... law or no law. lucky me huh? btw (perfect icon)

When I had looked into it, I am not eligible now because I am self-employed, but maternity DOES fall under short-term disability.
The other thing for you to be aware of-- if your company has under, I think 15 employees-- or maybe even 50, they do not have to comply with a lot of the NYS laws. I am not exactly sure what that entails, but I know they are not bound to many of the things that larger companies are.

I wouldn't even worry about her. Fill out your disability form with the disability company and fax it in. It has nothing to do with her. She sounds like a winner

thats only FMLA that is affected by the amount of employees. NY state and my disability ins. carrier both said it doesnt matter how many employees there are. the NY state rep said......... if there is disability taken out of paycheck (which there better be b/c its required) then i am entitled to short term dis for having a baby......... it depends on what your companies dis insurance covers u for.

oh and my dr told me that i do get it no matter what as well.......... i am really upset and dont need this added stress...................

u know what is so effed up, i have been here for 7 years and feel like and she still manages to make me feel like a piece of ****............... its all about being jealous tho............. i also confided in her that my little unborn son will need a little surgery when he is 3-4 months old.... (nothing too crucial) but still..... she should do all she can to try to make things easier.... not harder and we normally have a good relationship..... i dont get people sometimes..

WHAT A B**TCH...I can relate a little, our company is based out of Cali and the first in the NY office to get pregnant and my office/hr manager is clueless as to what I get...It's the most annoying thing ever..she tells me something different every day!!!

i work for a large company so i notified HR already. They are going to send me my papers after my anniversary in November- so ill be 6 months at that time. We get 6 weeks at 100% so during that time we can let them know when we plan to return. We can take an extended maternitly leave or tack on vacation at that point.

Yup my co gives me nothing as well, and she is just beyond confused to what I get based on law...its beyond frustrating!!!!

Even if your company does not pay you they are still required to complete the DB450 form (NYS disability form) for you. This is the form you'll need to file for NY State disability.
What an incompetent office manager you have. Is there someone "higher up" that you can complain too? This is really HR 101.

We spoke about it when I told my boss I was pg.. which was at about 12 weeks.

Some more information
yes she is incompetent but NEVER WRONG... so its annoying...... that link u sent is only if your disability insurance is NYSIF (not all of NY state) each carriers have their own policy (granted they are pretty similiar) yes i have the form, i am all set, but i feel my blood pressure rise when i think about it.... i am gonna have to go talk to the Pres of com.....

I wasnt planning to tell my principal until i was 12 wks but something came up in my pregnancy that she needed to know WAY earlier.
However, all she knows now is that i am PG but we havent spoken about leave. I will prob go to her after the holidays since i am due in May. My chairperson who is responsible for replacing me already knows my plans. He knows he will need to replace me for the remainder of this yr (May and June) and all of next year.

maybe she was confused and though FMLA is the be all and end all on disability for birth... and now doesn't realize she's wrong or is too stubborn to admit it... either way and you should get it.
i'm still early on, but i'm planing on telling my principal at 12 weeks-ish. i'm not sure as to when we'll discuss leave in full, being that you're 7 months and you're having all these problems at work i'd do it sooner rather than later. if it all goes smoothly, fine, but if not it gives you more time to argue with them. you don't want to be clearing things up in your 9th month.

you will get disability, but depending on the size of your company you may not be entitled to FMLA
