For teachers returning to work
How many sick days does your district allow before having to use disability?
Mine is 6 weeks for a vaginal birth, 8 weeks for a c-section.
I know that the 6 weeks of disability doesn't pay as much as my salary, so I haven't decided what to do about that yet.

not sure about disability...i actually dont think i can think that...but my district is the same as yours with the sick days 6 weeks vaginal birth 8 weeks c-section...i plan to take a total of 3 months which is allowed under the family medical act and i will have my health insurance during that whole time but wont get paid for the whole thing

Im only taking the 12 weeks allowed by FMLA. We have private disability insurance so we get more than most teachers get on disability (I dont work for the public school system).
I will not be taking any sick days in addition to my leave. The baby will be in day care. If she gets sick, odds are I will have to stay home with her. My sick days will have to be used for that - DH and I will have to alternate.

But let me ask you guys what you think about THIS:
I'm due December 18th. Our last day before Holiday Break is December 19th. I'm hearing that if I go before 2pm on December 19th, they will take my 2 weeks of Christmas break as part of my 12 total weeks of leave. Is that ridiculous??!!! I'm so angry about that--I EARN that vacation, especially since we don't get the Jewish holidays here!

I am using my disability insurance...b/c after my sick days run out, that's it.
I'd rather get half pay, then no pay at all.

Thanks ladies. Unfortunately, I can't afford at the moment to take the unpaid additional 6 weeks entitled to us from the FMLA. It is more unfortunate that I have plenty of sick days to use, but can't use them. I will use a couple of weeks before and then the allowance I am entitled to afterward. I will return to work while my baby is still so little. I thank you for the information.

I only get paid until I get medically cleared which is usually 6 weeks or 8 weeks. HOWEVER, I am due Sept 8th. Today I am 36 weeks. Say I go today. They start counting my 6 weeks today and then I only get 3 weeks paid when school starts. As much as I am done and miserable and want to meet DS, I need him to stay in until Sept 2nd.

4 week vaginal, 6 week c-section, but with a doctor's note you can stretch each by 2 weeks. You must use all your sick days, of course. Also, you can take up to 4 weeks before your due date. Then FMLA kicks in for 12 weeks.
I will have a scheduled c-section, and my sick days + FMLA will take me through to the summer, so I will have my insurance until september, when I return to work. 7 months at home, all together, all with insurance, but only 8 weeks paid (if I have that many days).
ETA: school vacations DO NOT count towards FMLA ever. that includes summer.

my district works the same way...for me i'll be out for spring break and that will count towards my 6 weeks or 8 weeks paid...i dont think i'll get the sick days deducted but i know i cant take more b/c of the holiday...their policy is 6 weeks not 30 days or something...such bs

As far as being able to substitute accrued paid leave for unpaid leave, you're considered disabled for 6 or 8 weeks depending on your delivery. If spring break or any school break fell during those first 6 or 8 weeks, you may not be able to substitute paid leave for unpaid leave during that break. However, any school break where school is closed for at least 1 week does not count towards the 12 weeks of unpaid FMLA leave to which you're entitled.

In my district, vacations count as part of your maternity leave (12 weeks FMLA) but do not count as days you need to use. For example, if you need to use 6 weeks of days for paid maternity leave you can subtract the days of vacation so you may only use 23 sick days instead of 30.

In my district, vacations count as part of your maternity leave (12 weeks FMLA) but do not count as days you need to use. For example, if you need to use 6 weeks of days for paid maternity leave you can subtract the days of vacation so you may only use 23 sick days instead of 30.
It shouldn't vary by district. FMLA regulations are quite clear on calculating the 12 weeks of leave for teachers. School breaks where the school is closed for at least a week and teachers are not expected to show up for work do not count towards the 12 weeks of unpaid leave to which an employee is entitled.

I am in the same boat as you, I am actually die over holiday break. I am making it very clear to my payroll secretary that my FMLA should begin on 1/5/09. If I happen to go earlier than mt 12.24 due date I will take a few sick days. No way am I losing holiday break AND President's week!

We can go back and forth on this, but you're wrong. I'm very aware of the FMLA laws and regulations. If your district counts school breaks of 1 week or more as part of the 12 weeks of FMLA leave, the district is violating the FMLA.
Taken from the FMLA regulations: (f) For purposes of determining the amount of leave used by an employee, the fact that a holiday may occur within the week taken as FMLA leave has no effect; the week is counted as a week of FMLA leave. However, if for some reason the employer's business activity has temporarily ceased and employees generally are not expected to report for work for one or more weeks (e.g., a school closing two weeks for the Christmas/New Year holiday or the summer vacation or an employer closing the plant for retooling or repairs), the days the employer's activities have ceased do not count against the employee's FMLA leave entitlement. Methods for determining an employee's 12-week leave entitlement are also described in Sec. 825.205.
