DH was let go - Employment Lawyers?

Fri. DH was let go w/o any warning or anything. His boss had been acting weird the last month or so and I felt like something was up, but nothing was ever said. DH worked his butt off - late hours, in early, a hard worker. He was there a year and a half. He's being asked to sign a letter, I'm assuming we should seek an employment lawyer?

Does anyone know if he's allowed to ask to see his employment file? We're wondering if anything was ever written in his file, other than good things. Is there any recourse? He was given 6 weeks severance, but I'd like to try and get more, esp. with the economy the way it is.

oh boy.... I'm so sorry......

yeah, there's something fishy about that. Definitely do NOT sign anything without legal consult... who knows what's in that doc... could be that he's waiving his right to unemployment, and that he's 'quitting'.... could be waiving the rights to some benefits.

Im not sure what the laws are here, I do know when we were in SC I had this issue and my employment file was public to myself if I wanted it. I would call someone and see what it is in NY. Is NY an atwill state? I dont know if that matters or not

I'm not an attorney, by NY is an at will state and you can be let go at any time.

They don't have to give severence, so that is actually nice of them. I was fired at 38 weeks pregnant last year with nothing, I got unemployment, and your DH should be able to as well.

My dh lost his job this time last year and I know how hard it is going to be. So sorry this happened to your dh.

Thanks everyone. I forgot to add that his employer is in CT - if anyone knows anything about CT employment law? We live in NY, but the co. is CT.

CT is also an employment at-will state. Unfortunately, unless he has an employment contract, his employer can fire him for any lawful reason (can't discriminate, retaliate, etc.). It's always a good idea to speak to a lawyer, especially if he has to sign something.

DH was laid off in January 07 - he didn't see it coming, had been there almost 2 years and was told they were doing away with his position - several months later they rehired for the same position. He's still not sure what the he ll happened with that job - he loved it there and was paid so well!

Good luck to your hubby in finding a new job!
