disability?
I'm not sure if I'm eligible for disability. I got put on bed rest at 31 weeks. I have enough sick days to get paid until April 9th. I'm not due till May 3rd. I looked on the NY state web page about disability and it said that your employers need to fill out the forms....but my job doesn't offer disability insurance and the business office said that they have never done that before. So...does anyone know if you are eligible for disability during pregnancy or after you give birth and if so how do I go about getting disability?

Look to see if your company meets the requirements of FMLA.
Through FMLA you are entitled to 12 weeks off, and 6 weeks of it paid through short term disability. Additionally through FMLA they are required to hold your position, or a position, for the same rate of pay and benefits (health insurance, 401k, etc).
You have to have worked for them for a minimum of a year and the company has to have a minimum of 50 employees (I think).

I am pretty sure that your Dr. needs to fill out forms for you to collect disability for going out of work early. I know it is possible to collect if you are out for medical reasons by order of your dr. I think you can collect total of 26 weeks.

Thanks for the info. I do get FEMLA leave so I know I have a position to go back to. I will ask my Dr. office about filling out the paper work.

For short term disability, the NY State form I filled out had multiple parts. I filled out the first part. The OB had to fill out the second part and my employer had to fill out the last part. Short term disability covers you for 6 weeks if you have a vaginal birth and 8 weeks if you end up having a c-section.

"paid" is a relative term I am afraid. NY State disability is paid at $34 a day, $170 a week. The pp was correct about the form being three parts. I am the leave admin. for my firm so if you need the forms please send me an FM and I can send it to you.

FMLA has nothing to do with eligibility for STD. FMLA only entitles you to 12 weeks of unpaid leave. STD, which is paid leave, is completely separate. If you are eligible for both, FMLA can run concurrently with any paid leave under STD.
It's a good idea to speak to your employer or the State Insurance Fund if you have questions.
ETA: Most NY employers are required to have disability benefits insurance coverage. Does your employer have a policy?
