What would you do, need opinions

DH and I currently live in an illegal apartment and are month to month on rent, no lease. Oct will be our last month in the apt since we plan to close first week in Oct and then have some work done before we move in. We are going to Europe Sept 20th-30th and we really don't want to tell the Landlord we are moving before then, DH is nervous to have him showing the apartment while we are away.

Question is, do you think telling him Oct 1st, that we will be out by the end of the month is enough time? or tell him before we leave for vacation?

we were in the same sitch.. we told him the 1st we'd be out in a month.. i didnt want him sending workmen and stuff into our place to fix it up while my stuff and cats were still there
we lived 1 week in the old place.. and used it as storage for 3...
i dindt wnat to give him any extra info

IMO, I would wait until you get back from your vacation. One month is more then enough time for them to start showing it. GL! Chat Icon

did you ever talk about how much time to give when you first moved in? if you have no lease and never discussed it with your LL, then i would say 1 month is enough time. it's not in my lease but my LL asked for 2 months notice so we will honor that. good luck!

Did not discuss it at all, I actually have been living there for almost 6-years in total.

under most landord tenant law you only need to give a month notice if you are month to month

All you're required to give as far as notice is concerned on a month-to-month is 30 days.

It's an illegal apartment. You can tell him you're leaving tomorrow and there is nothing he could do about it.
Unless you have a security deposit you're looking to get back. I would tell him whatever works out in your best interest.

I agree with pretty much everyone! I'd wait until you get back. You may want to type up a nice letter, dated Oct. 1, before you leave for vacation that way if you do not see you LL right away, you can slip it in his mailbox so that your notice is 30 days.

After 6 years, I'd think you'd have a decent relationship as well has LL have some inclination that you would not be there forever. Especially if you just had a momentous occassion... wedding, baby... usually is followed by new address!
