I'm not familiar with any of this, so how do you know if its a legal or illegal?

Def familiarize yourself with Fair Housing Laws in NY, so you know what's considered discrimination. I am very familiar with the Law in CT,sorry I can't be more of help there.
You can always check with the town hall you are thinking of renting in and see if the apartment is registered.
