FMLA?

Can somebody answer a question for me is it you are eligible if you been at work at least 12 months and 1250 hours or is it 12 months or 1250 hours?

This is from the Dept. of Labor's website:

Q: How is the 12-month period calculated under FMLA?

Employers may select one of four options for determining the 12-month period:

the calendar year;
any fixed 12-month "leave year" such as a fiscal year, a year required by state law, or a year starting on the employee’s "anniversary" date;
the 12-month period measured forward from the date any employee’s first FMLA leave begins; or
a "rolling" 12-month period measured backward from the date an employee uses FMLA leave.

You have to have worked at least 1,250 hours over the last 12 months at your employer.

Thats what I thought, I was just hoping for the OR 1250 hours, becasue I miscalculated, we started TTC a month to early.

technically you could still be okay. Consider this...if after you had the baby you went back to work after your 6 or 8 weeks of disability then you would have your 1 year and 1250 hours and would be eligible for FMLA then to take care of a newborn.

I never thought of it that way. Good idea. I don't think we could have waited any longer anyway to TTC. Well I have to wait to find out I am in my 2WW..
