Tenant rights - hot water

Does anyone know what our rights are - we live in Queens in a two family house and our hot water went out yesterday, and they had to shut the water off entirely. They think it will be out for 3 days. They offered us a hotel, but we have 3 young kids and opted to stay with my parents instead of leaving the kids with our nanny in a hotel room all day. We are moving out this weekend, so we can't withhold next month's rent. Can we request a portion of this month's rent to be refunded?

I don't know about rights but they offered a reasonable accommodation so I woudnt fight them on rent. Were you prorating February rent since you leaving a week before month end?

Re: Tenant rights - hot water

if youve been there for a while and have a good relationship with the owners, id just let it go.

My bf rents his apt from someone we both love. Hes been there 16 yrs. I have to shampoo my hair before i get in the shower (which i do anyway) but 3 min later i have to turn the water off and shave my legs with whatever water is on my body, then turn the water back on to rinse off since hot water runs out. The kitchen sink only has scalding hot water so I refuse to cook or do dishes there. Has he said anything? NOPE. I complained AGAIN to him about it last night and hes like :u want me to say something??" i go "no, youre leaving soon anyway.. fk it"

id just let it go.

I don't know the law, but it sounds like your landlord is making a good faith effort to fix it AND to give you alternative housing. Sounds like he is being reasonable.

Your LL is repairing it and gave you an option of somewhere to go. If they did nothing then you could get something but they are doing the right thing IMO.

Thanks all.

To clarify - I have NO water at all, so we can't even use the bathroom.

They claim they need to wait for the insurance company to come before they can start repairs, and the insurance company won't get back to them.

Why are you asking for rent to be refunded when they offered a hotel room?

Because I have a 4 year old, 2 year old and 5 month old - they can't stay in a small hotel room all day. Plus then we need to eat all of our meals out, and how will my nanny feed the kids? Or give them milk?

Not when they are rectifying the situation and in turn offered you paid accommodations while it's under repair.

If they left you for 3 days without running water and no course of action taken then yes.

The fact that you have kids is not really the landlord's problem. God forbid the nanny has to be a little inconvenienced or take the kids out during the day. How you eat your meals is also not the landlord's problem. Buy smaller sized milk to fit in a hotel refrigerator. Be happy the landlord offered you accommodations, many landlords may not even bother.

Even if the landlord offered you a 2br suite it sounds like you are just trying to penny pinch here and you had every intention of staying with family.

This is not about penny pinching - I'm just looking to be compensated for the inconvenience. I am moving out on Saturday and was told that I won't have water back before then. I tried to move the movers to tomorrow or Friday and they won't do it. It is a HUGE inconvenience for me to be out of my house. Have you had to take 3 kids under 5 out for the day by yourself? It's not that easy! We have my parents nearby and can stay there, so that is much more comfortable for my kids than sticking them in a hotel room all day. The hotel would be paid for by the insurance company - they aren't paying it out of pocket, so it means nothing to them. And at home I have food to cook, but without running water I can't cook any of it, so it is a big expense for me to stay at a hotel and order in every night for 3 nights, on top of having to call in food for the kids. I have enough expenses with moving and can't really afford any more.

They offered you an accommodation and you chose not to take it. You're not entitled to anything aside from that. I understand that it's a huge inconvenience with the kids but that's life. We can't expect to compensated for every unforeseen circumstance that occurs. There's no negligence here.

Hotel room won't work with small children, it would be super hard with toddlers running around, and a baby trying to nap... so I get it. I think his home insurance should cover any missed rent due to this reason (not sure though).

If it is such an inconvenience, why would you wait until the weekend? The more days you are out of your home, better your chances to get some rent reduced.

eta: just saw your note about the movers, can't you get someone else? what about renters insurance.. assuming that would cover some of your expenses since you are refusing the owner's accommodation.

I will lose over $500 if I cancel this mover - I asked.

Good idea to check with my rental policy!

Are you moving out permanently or just until the water comes back? I'm confused.

Since you are staying with your mom are you going to be paying for anything? I still think let this one go.

Your landlord did what was appropriate- they offered for you to stay in a hotel and that fulfills any legal obligation. You could calculate what you pay for rent per day and ask them to refund you that amount for your inconvenience- they are under no legal obligation to do so but they might consider doing it in good faith. It cannot hurt to ask.

Since the hotel room is being compensated by the insurance company, not the landlord, I'd say its even more unlikely you'd get anything from the landlord. I agree with others to just let this go. Good luck with the move!

Assuming your new place is available, which it sounds like it is, why don't you just pack a couple suitcases and "move" earlier with a few things? This way you have access to a kitchen and fridge for cooking purposes and the kids have space to run around.

ETA - or at least bring some stuff to the new place to use during the day, and just go back to your parents to sleep at night (though maybe you can just borrow a couple air mattresses from someone)

Im not sure why you would WANT to? Your LL seems like they are correcting the problem and offered reasonable accommodations while the repair was taking place. I would say no, not positive, but sounds like the LL did the right thing and acted quickly.

Re: Tenant rights - hot water

When we were renting we had major water issues and our landlord didn't make us pay for those days until he got the water fixed - but we were able to stay in the apartment. He offered to pay for a hotel for us, too. We were in a luxury building, though, so there was a gym with a bathroom upstairs that we were able to use.

I would expect your landlord to do something similar, like not charge you for the days you can't live there. BUT, since you're moving out, he really has no reason to be nice to you. He probably wants the money and no need to stay on good terms since this is your last few days there anyway. That's my guess what's going on.

I don't know the legal rammifications and what he is required to do, but id ask him. You have nothing to lose....look at it this way, If you don't ask you have a 100% chance of getting nothing, if you do ask you might get something. I wouldn't pursue it further than a request. If he said no it's probably not worth the time to fight it. But it's as simple as a phone call explaining your situation and hardship. If you were a good tenant he might be sympathetic, you honestly never know.
