Re: CPS question...

There are other issues and incidents. This is just the only time a drug test was actully taken by the hospital. Which is why I am wondering if cps could get the results. The only "real" evidence thats not hearsay
I would just ask the CPS person at this point if they intend to look into getting these records. This seems like a fishing expedition, TBH. Again, if the person was found to be DUI I would think they would get arrested or summoned to appear in court. But since the child was not in the car not sure how it is a CPS issue.

Child was not in car at the time of accident - cop said the adult would have been arrested but needed to go to hospital for injuries. And he told doctors to do blood work. It was a single car accident. Family was told adult could still get a summons to show up in court for DUI in the mail.
To be honest based off this since the child was not in the car, I don't even think CPS will be involved. And even if someone made a complaint to CPS, it will be hard to prove child neglect based solely off of this incident. It sounds like since they went to the hospitals they may even be able to fight the DUI and get it trumped down. Not saying this right but it's the way it works, especially if they get a good lawyer.
I agree with this. Is cps involved with the family for previous issues that are being investigated?

I highly doubt it. The police report maybe but not the hospital records. Like others have said, if the child was in the car and the hospital felt the need to call social services then they would have all the information. However, the situation you explained seems like a stretch for them to be able to access the hospital records.

Re: CPS question...
For what it's worth I work in a hospital and a mandated reporter to ACS (In NYC it's ACS, not sure about LI or NJ or whereever else).
If someone shows up to the hospital after a car accident a drug and alcohol test can be routine (esp for a bad accident). (i.e. if you walk in with a sore arm). If there's a positive drug test I would think as a mandated reporter you need to call ACS if there are kids in the home.
Once they are involved it's anybody's guess what happens.
