Hi Ladies,
I am hoping this is the right board to post this question on...

A friend of mine has two young boys in daycare (9 months and 2 years old). being that daycare is strict in terms of not taking children when they are sick, my friend has been out of work a lot...to the point that she is negative in her sick & vacation time to the point that her supervisor told her that her job is in jeopardy.

does FMLA somehow cover this??
has anyone been in a similar situation that can offer any advice?

They think the older son may have asthma but im not sure its a confirmed diagnosis...would that count for FMLA?

I can't answer the fmla question but my daycare takes kids with colds with the understanding that of they didn't, no one would ever go to work. The rule is no fevers.

Mycompanys terms state that you can take FMLA to care for a family member who has asthma.

It would be considered Intermittent leave.

From my HR site:

Intermittent leave would be when you take leave for periodic treatments on an occasional basis rather than a single block of time. This kind of leave is usally approved to care for the employee or family member's chronic conditions (such as asthma) that require the employee to take time off during periodic flare-ups.

I think it might. My DHs friend was sick and in and out of work a lot. The company took the days off of the 12 week FMLA he was entitled to until it was used up. But he was the sick one. Not sure how that would be handled if the child is sick.

What you are describing does not meet the definition of FMLA. Also FMLA can not be applied retroactively.

ETA: Just saw your Asthma note. This may be considered, she should contact HR for FMLA paperwork.
