we just came back from........

signing the contracts on that house!!!!

they re-issued them with all the changes we originally agreed to (well almost all of them) Chat Icon

they even called my attorney 2x today looking to see if we signed them and sent them back yet Chat Icon now they are in a rush!!

closing dates was moved to on or around 2/25

thanks for everyone's support through it all!Chat Icon I needed a place to vent!! I hope it works out this time! I can't see how it wouldn't its the contracts they wrote with no changes from us.

We were a little p!ssed though when we heard from our attorney today. He is charging us $975 which seemed fair. When we hired him we explained that the people were crazy and all the problems we had just to get the home inspection, so I can't say he didn't know. But he said he has to charge us $350 more for all the extra work he has had to do. Chat Icon Chat Icon I really don't think its fair because not one single issue was our fault, but DH wouldn't let me neg. about this. Does anyone think that's fair??
(the extra work consisted of reading 3 sets of contracts and mark up, and numerous phone calls, faxes and emails to their attorney over the course of 2 months, nothing else) maybe I am wrong to feel that is excessive, but I really do.

Good luck! I agree with you, I don't think it is fair he is charging you more (we went through a similar situation and our attorney didn't charge extra) but also, 975 is a good price for an attorney. Mine was 950, but most are over $1,000....

And no, I do not think the extra fees are fair. You paid him his $950 to do exactly what he did, thats why you hired him in the first place!!

Congrats! We had a similar experience with our sellers/contracts and paid MUCH more than you so I think that price is fair!

thats how DH feels too. And he had a good point last night. our closing is going to be something that has to happen pretty quick. so he will have to do it quickly. so at least we compensated him for his time and we don't owe him anything, and he can't feel like he doesn't have to do things in a timely manner because everything has been such a PIA.

I know a year from know, if it all works out Chat Icon all the stress and money will all be a distant memory Chat Icon or so I hope

If it makes you feel any better, we had similar problems to you with the bidding/contracts and it was a PITA every step of the way with the seller but once they were signed, it was as smooth as could be. Hopefully the hard part is behind you Chat Icon

its only the beginning...Chat Icon Chat Icon Chat Icon be prepared to have your bank on speed dial... lol ... the mounds and mounds of papers they need for verification is endless... and sometimes you send them in 2, 3, and even 4 times... god, i know im debbie downer right now, but coming from someone who was suppossed to close over 1 month prior to our actual date, i can only warn you...

if its quick for you, thats wonderful and consider yourself blessed... you can threaten the bank all you want to push you along, but in the end, the freaking underwriter works at his/her own speed... they couldnt care less about your own personal situation (believe me, we were getting kicked out of our apt with nowhere to go and they didnt move it along any faster)... it really can get horrible and nasty so just prepare for the worst, and hope you get the best possible closing :fingers crossed for you:

$ 975 really isn't that much. I've worked for a few R.E. Attys and that's really not a lot. Many attys charge over $1,000 for one transaction. To be fair- he did do a lot of extra work for you compared to what others who pay the lesser fee get out of him, right?

thanks for the info! our bank said he has been closing all of his FHA loans in under 60 days. we told him to give us the biggest window we would possibly need because we could see these crazy's sueing us if we didn't close in time. so he said 60 woulds be completly fine. Chat Icon he's right!

I didn't neg the $975, thats what he choose to charge even when he knew all the problems we were having with them from day 1 before we started with him. he didn't really do THAT much work extra, that's why I feel like I have a problem with it. but there is nothing we can do about it, we gave him the $. I just don't think it was completly fair. I called around for attorneys and and I got quotes from $900-$1100. we went with him becuase DH works with him.

it really isn't the end of the world, but maybe he should have told us 2 months ago when it seemed like the work was getting excessive, that he may have to charge us more. instead he left it to the phone when he told us the good news and bring another DP check for x and also I will need another check.

I can't be mad though, it is what it is Chat Icon

Ditto! That's his price and that's it. it's his job to protect you from contracts that do not represent you properly. if the sellers weren't cuckoo BUTtheir atty was an idiot and wrote dumb things in the contract time and time and time again, that's his job to remove them.

when he quotes a price, he has to stick to it... that's my opinion.

ETA: gather all your paperwork up and put it all into a folder and keep it with you at work / or at DHs job that is near a fax machine. if anything is necessary to be re-faxed, tell them you are walking over to fax machine right now.

my people at the bank got all my info once, and never asked for anything again. i had a great team of people though.

I have been emailing a ton of stuff over. can you FM or post here what you think I will need?

so far I have 6 months of bank stamtents, w2's for 07 and 08. termite report, paystubs for 2 months DH and I, DH's work contract with raises outlined (they asked for this) But I know everyone says they need a ton of stuff! I feel like this is not that much! I actually have the folder with all the stuff with me at work so I can send things as they need them Chat Icon we are still waiting for the signed contracts from the sellers back, because the bank can't go any further without them
