12/27- we got a call from our real estate agent today, telling us the sellers recieved the co they have been waiting for and they are ready to sign the contracts this week. they are going to send us over a new set of contracts to sign.... I know I should be so excited that its actually working out (maybe) but this darn house has fallen through so many times on us, I just feel like its to good to be true. either way, DH and I thought long and hard, and we really do love the house. we haven't found a single house that compares, even lookiing at ones for 50K more, so we really want to go for it. but this time around we are thinking of putting deadlines.

Dooes anyone know if thats possible? like we would like to sign the contracts and send back, but say they expire in 5 business days if not signed, or something like that? just in case this isn't the end of their games.... is that possible? or any suggestions of ways to protect ourselves??

if you haven't been keeping up with my he!lChat Icon of trying to find/buy a house-long story short we have the worst luck! lol

we found THE house is sept put an offer in it was accepted Oct 1. sellers dragged their feet for weeks and canceled 2x our home inspection but after I think 3 weeks we finally did one. Everything went fine. told them to draw up contracts. that took i think 1.5 months. we got them around nov 21 to sign. Signed and wrote downpayment ck and sent them back. they didn't sign them and 2 weeks ago we asked for our ck back. they are waiting on a CO to come through and they don't want to sign until they get it Chat Icon its always "something"

needless to say, we are tired of waiting. we are living with family right now and its getting really hard, we want to move out now!! We told our real estate agent that we love the house, and want to buy it but in the meantime we want to keep looking at homes(we are not in contract nor bound to buy it). if we find something else, we are buying it. if they figure out what their problems are and get serious, they can sign the contracts and the deal is back on. My attorney put in writing the deal is offically off, and they need to issue new contracts if they want to re-open the deal, and we got our check back. so the deal is offically done unless they issue new contracts.

My issue is this, and this is where we might be unrealistic... we want to continue to look at houses. If we find something that we love we are done with that house and we are buying whatever else we find. we don't want to wait forever. as it is we have wasted almost 4 months on this one house, that may never even work out.

We sense an attitude as well as some resistance from our real estate agent to continue to show us houses. Is this to be expected? I can't continue to wait for that house, I need to move out ASAP, and I have expressed that to my real estate many times. Should I not be allowed to see other houses or something?? I don't want to step on toes, but I cannot continue to wait Chat Icon

i have been reading all of your posts on the house stuff so i feel your pain, i would be beyond frustrated in your position......

if you are not in contract with the house then legally there is absolutely no reason not to keep looking and if you agent is not being helpful there are ways out of that agreement as well

Ugh Heather this just stinks.

First of all it's time to find a new RE. In this market they should be bending over backwards to make you happy, especially if they can obviously see that this deal isn't going through. I know you're thinking about Nassau now but if you want to stay in Suffolk I'd happily recommend my RE to you. She showed us tons of houses with no complaints, sent us new listings every day (even after we were in contract!) and when she couldn't show us places she had her co-worker take us so she could accomodate our weird schedules.

Secondly - am I reading it right that you got your check back? I would RUN from this house. It's been nothing but headaches from the start.

DH and I found "our" house. We never got it - they never accepted our offer. We still drive by and wonder what it would have been like Chat Icon But the truth is we absolutely adore where we live now and can really only think of the positives versus the negatives (of not getting "our" house).

Keep looking. You'll find it. It's out there

You have to try and get a realistic date from these people (seller). I understand the want/need to move out but even if you find a new house tomorrow you are probably 2-3 months from closing on that house. So if you think you can close on the "Old" house in that time I say stick it out if you love the house.

As far as the RE agent.....if she is giving you an attitude I'd ditch them.

I feel your pain....we found our house in Sept and have not closed because the people at the bank are incompetent.......they have everything they need but refuse to give us the clear to close for no reason.

I would express to your REA that if he/she can't take you out to see more houses that you will find a new REA. Simple as that.

It sucks while you're in the middle of it, but when you get the perfect house it will ALL be worth it. (not that I ever have a free second), but when I do I sit and grin and squeal cause I am SO happy with our new home. It's EVERYTHING we wanted. We waited a LONG time and in the short 2 months we are here the blood, sweat and tears is ALL worth it. Follow your's and DH's gut and you will find your dream home! Good LuckChat Icon

thanks for everyones input. I really like the real estate we are working with so I hate to change, but at least I know that we are doing the right thing and seeing other houses is not to much to ask.

Based upon all of your posts, i think this is a blessing that the deal is off.... I know that sounds harsh but it was starting to get shady...

PLEASE find a new real estate agent. I think yours is not meeting your needs (I have been following your posts).

Good luck. I cannot wait until they day that you annouce that you are closing on your house! YOU DESERVE IT!

If you are not in contract, then sure you can look at other houses! If I were in your position, I would do the same thing! You are not being unrealistic in anyway! If anything it's smart to look at other houses, because like you said why waste time like that!!! The best advice I can give you is NEVER SETTLE!!! When you find the right house, however long it takes, you'll know! Don't settle on something you don't really like just to speed up the process! please..I did this and now I regret it everyday of my life

i've read your posts too...what a nightmare! do not let the agent push you at all....this is your money and your future. explain again how you feel and if she doesn't want to take you out, tell her you'll need to find someone who will. i know it's easier said then done...stay strong and good luck!!

If you sense any attitude, FIND A NEW AGENT.

I have an excellent agent that works in the south shore Nassau County area if you need one.

You can have your atty add things to the contract. I'd speak to your atty and they can help you with putting in conditions that will help to move the seller along.

Be careful on pushing the closing date too much because the banks have been super slow in giving the clear to close so you will need probably 60 days for all the mortgage paperwork

thanks! we are sooo not in a rush at all at this point. I work in accounting and tax season is my busiest time. we were in a rush to close before it started but that never happened. so the longer we can drag it out at this point the better Chat Icon . we are just going to ask them when do they want to close because no matter when it is, it will be a pain for me. but i would rather it be when they actually can close, then have more issues with having to push it back
