Tree Problem with neighbor...
What if someone's tree is so close to the property line that the roots are a tripping hazard and ruining your concrete?? My aunt's driveway is lifted 6 inches because of it... Any recourse?

I guess you could have the driveway done and cut the roots. That would kill the tree.

Well if your aunt decides to do the work to her driveway, then she has to pay.
Has she spoken to the neighbors? You didn't mention if she did.

I believe if its on your property you have the right to remove it in any form. It would be at your cost.

She did speak to the neighbor - the neighbor isn't doing anything about it.
I know if the branches overhang - you are responsible (monetarily and physically) for cutting them, etc. I wasn't sure if the neighbor would be responsible b/c their tree is causing actual damage.

She really should take her town's word for it to avoid issues if the tree is adversely affected by cutting the roots. There's no going back once it's done so I would make sure everyone's clear before I did anything.

i dont know the rules, but maybe your aunt could offer to split it with her?
my aunt just had a tree removed from it was technically her neighbors tree but some of the roots and such were on my aunts property. it was also in a bad spot for the neighbor because the tree was directly behind and touching her shed. anyway, my aunt spoke to her neighbor and they split the cost.

I think if the damage is on your aunt's property then she has to pay to fix it since the tree was there when she bought the house.
