Tenants have any recourse?
We are moving from an apartment complex to a house at the end of this month.
The people that live below us are simply terrible. We can't make noise past 8pm (even though quiet hours are 10pm - bc they have children) - these were changed by the complex. They attacked me, the cops were turned away by the guards at the front gate. Its just compiling and compiling. I called a few days ago because they are loud during the day and I sleep at night (as I was told the quiet hours would change when I went to nights and we would ALL have to be quiet around the clock) - but apparently, that rule only applies to us, NOT them.
So after making that phone call, they started banging on the ceiling ALL day yesterday, I was scared to leave our apartment, since they already came after me.
Calling back today, the complex has no one higher than the office manager who works there, and she was the one who has said to me 'well what do you want me to do about it?!' - we are breaking our lease since we don't feel safe here and a house came up that we can purchase.
What are we able to do about it as tenants?
We are refusing to pay the last 3 months of rent because this has been going on for 6 months without anything being done about it.. we are approaching them tomorrow morning and requesting being let out of our lease without penalty, but in the mean time - do I resort to being loud until 10pm week days and 11pm weekends? Do I jump up and down on the floors and make insane noise like they do?
HELP!

As mad as you are, I wouldn't do this. It just gives them a reason to put blame on you.
I would take any documentation you have with you regarding the situation with you when you meet with the leasing manager... dates and times of all complaints; any times cops were involved; any correspondence with the leasing office staff, etc. Make sure you explain in detail the agreement that you and your neighbors had and how the leasing office was aware of it and how your neighbors didn't abide by the new set of rules.

if you are refusing to pay for the last 3 months, you should have that money put into an escrow acct so that they can't say that you haven't paid and use that against you. You should also write a letter to the mgmt company (although it might be too late at this point) stating your complaints and informing them that you will not be paying them the rent and instead ptting it in escrow until action is taken. Again, it might be too late since you are already moving but you don't want the mgmt company to have anything on you and you want to document your issues and complaints.

We are meeting withthe 2nd office manager tomorrow morning at 9am to go over being let out of our lease at the end of the month, without being responsible for the rest of the months. hopefully this person has somewhat of pull and can complete this, since nothing has been done to make it better in all of this time.
I printed our phone bills showing each time we called to complain, the police report, etc.. and bringing it all with me... hopefully it works..
