I might just kill a realtor (UPDATE)*** ANOTHER UPDATE 2
So yesterday we put in an offer for $10 above asking price on our dream house (this happened at about noon)
We faxed over the offer, pre qualification of mortgage, and bank statements showing we have $$$ in the bank. My dh is the realtor and mortgage broker and disclosed that info in the paper work.
House has been on market 12 days.
At 8:30 last night dh called the realtor since he had not heard from her and she said that she was waiting on a few more offers before she showed the owner our offer.
***, you can't do that, we know she is playing games b/c if one of her buyers get the house than she gets a double commision. But she did not even tell the owner that they received an offer above listing price and from an overly qualified buyer.
So dh is calling her this morning and asking permission so he can present the offer directly to the owners himself.
If this chick loses this house for us because of her greediness I will lose my mind. We might even call her broker (boss) and explain what she did if we can't get anywhere with it today.
PLEASE, PLEASE, PLEASE send us some good house vibes. This is our dream house and if we get it we can be in by July which is what we were hoping for.

So Dh spoke to this realtor's broker (boss) and it ended up that the boss was my dh's realty teacher when he got licensed. He explained what was going on and she told him that b/c the house was so new on the market, the owners requested to give it a few days after the open house and then come to them with all offers and they will decide. They will not be countering at all just picking the highest offer and best deal all around (down payment, pre approval, etc.)
The boss told dh that almost all offers were in, there might be one or two more today or tomorrow but AS OF NOW, we have the highest bid so it is looking good still.

We got the house. Holy crap, will be closing early July!!!!!!!!!!!!!!

can your DH forego the commission so she receives full? perhaps the sellers stated that they want all offers by x date and then they will review. my sister is house hunting and was told by a few agents that this what the buyers requested.

Your DH has the right to present the offer to the homeowners himself, unless the sellers signed saying all offers through listing agent, in which case you should demand a signed offer aknowledgement form.
