ugh danielle this is beyond ridiculous... i am so sorry you guys have to deal with this now. and SHAME on your lawyer for speaking to Newsday without your consent - especially since your father made your family's wishes VERY clear.
good luck tomorrow... i really hope Newsday prints some kind of retraction or elaboration to this article.

But really, that is so horrible and this just proves how these reporters will print anything !

As I work in a law office, I didnt find anything wrong with what was in the article. You could have actually filed a malpractice suit against your attorney if he HAD NOT filed the claim against the County and your time to do so expired. (He should also have filed a Notice of Claim against the State as well). You only have a certain amount of time to file a claim against a municipality. The Notice of Claim is PROTECTING your family's interests. As a PP said just because a Notice of Claim was filed doesnt mean that you are suing the county or the state. You are just "officially" putting them on Notice. Additionally, a Notice of Claim would have been reviewed and signed by a member of your family in order to have been filed.
I'm sorry for all the aggrivation this has put your family through. If anything, your attorney should have explained the process to you more fully.

The other thing is - I spoke w/ my Dad, who is SO upset, and he never signed anything. Something is wrong here - we won't know more until tomorrow but why, when we told him we don't want to ever sue the county, would he do that? That's what I'm not getting.
I also think, regardless, that he should have asked us before ever speaking to Newsday about our personal business. But that's besides the point.
Thank you though for trying to help us understand more. This is something a good lawyer should be doing being as we have no experience w/ this sort of thing and are under enough stress.

ITA - i completely understand about your attorney having to file the notice of claim, he may have done it to cover his own butt - it doesn't mean that you have to sue the county, but there is NO WAY he should have spoken to Newsday without your permission, for THAT ALONE i would fire him.
plus, the article specifically states that your brother "plans" to sue the county - which is obviously not true, as you have told us. i would love to know whether this is something that Newsday "assumed" because the attorney filed the notice of claim, or if this is what the attorney actually said.
i hope this all gets straightened out today.

It was so wrong of your attorney to give any comment to the news. You need to tell him asap that that's not acceptable!!!!
I worked in a personal injury law firm for years. He was totally covering his arse. We used to do it all the time. We'd put everyone and their mother on notice just in case. The statute of limitations to put a goverment entity on notice is so short. Usually, at most, 90 days. So many things can happen in the future. This was done in your brother's best interest, I'm sure. Clients change their minds all the time but by filing this notice, it in no way means that you are going to go forward and sue the county. It just reserves his right to in the future. Right now your father is making all the decisions but I'm sure your attorney is worried that when your brother is well enough to make his own decisions, they may not be in line with your father's. I'm sure your attorney is also worried about that other officer that was hurt in a nearby location. If the courts find the county responsible for any part of that accident, it could affect any settlement your brother is entitled to.
Don't get me wrong, I'm not defending his comments to Newsday. I'm just trying to help you understand his thinking a little better. Definatley talk to him asap and make your thoughts known!

I'm an attorney and I have dealt with countless Notices of Claim.
If you EVER want to sue the municipality, you MUST file the Notice fo Claim within 90 days of the injury. It just puts the municipality on notice that you MAY sue them. It doesn't mean you have to.
While this is aggravating for you, I completely understand what the attorney did and why he did it. If it turns otu there was some defect in the road, and the notice of claim was not filed, you would be prohibited from ever suing the municipality.
The attorney here is truly acting in the best interests of your family. He is just trying to presrve your brother's right to sue. It doesn't mean he has to sue.
