Re: OHHHH I have gossip.....
How can that be a violation? Don't you have to release medical history in order to violate? Thats why you sign the paper when you go to the doctor, so they can share your history with another doctor or hospital if need be. Am I wrong??
All she said was that he was a patient. Anyone could have seen him at the office. Oh well....the whole carmen thing was news to me! I never heard that rumor!

Re: OHHHH I have gossip.....
I htought the hippa law was that the doctor couldn't even acknowledge if someone was a patient or not. The way I see it, no violations from the ZLA to NY doc but why did the NY doc tell you? That's where I think the problem is

Re: OHHHH I have gossip.....
As Deb said, I thought HIPAA also covered not even acknowledging that a person is a patient of a medical practice, office, etc. I know someone who was fired from a medical office for divulging info about a patient being a patient. If it is not against actual HIPAA regulations, I think it's highly inappropriate and I'm sorry, shows badly on the practice/doctor. I think we all have, and should have, the expectation that when we're going to a doctor, hospital, clinic, etc, that our private lives and health are not going to be shared with anyone unless medically necessary - consult with other physician, etc

It is too late now, that eye surgeon already told the whole world. Ooops! Someone is going to have a lawsuit if Steven Tyler's people come accross this site.

Seriously! We gossip about celebs all day and I'm pretty certain that the way the information is obtained is slightly illegal (not saying that Q steals the gossip, just saying that the paparazzi are probalby breaking a few law to get the info that we see here daily). Why jump on this one?
It's old news, but it was more speculation before, now it's kind of fact instead of us making something out of nothing.

WHAT IS HIPAA? "HIPAA" is an acronym for the Health Insurance Portability & Accountability Act of 1996 (August 21), Public Law 104-191, which amended the Internal Revenue Service Code of 1986. Also known as the Kennedy-Kassebaum Act, the Act includes a section, Title II, entitled Administrative Simplification, requiring:
-Improved efficiency in healthcare delivery by standardizing electronic data interchange, and -Protection of confidentiality and security of health data through setting and enforcing standards.
More specifically, HIPAA called upon the Department of Health and Human Services (HHS) to publish new rules that will ensure:
-Standardization of electronic patient health, administrative and financial data Unique health identifiers for individuals, employers, health plans and health care providers -Security standards protecting the confidentiality and integrity of "individually identifiable health information," past, present or future.

Just so you all know HIPAA is actually to make medical collections easier under the guise of protecting the average consumer. It also protects people with AIDS or stigmatized illness from persecution. Good gossip though!

Re: nm
The HIPPA law only takes affect when the patient signs it. He isnt a patient there yet, at least thats what it sounded like. but who cares anyway

I totally agree. Besides HIPPA there are other confidentiality laws in place that forbid you from giving out information about a patient. Even if you don't give the name of the patient but give enough information to identify them, you are in violation. You can't even give out information to a spouse or family member unless the patient consents to this, and in some cases certain information from teens to parents.
