O M G...updated...

We're not closing on Monday.

The seller is bing "difficult" and says that she doesn't have her stuff out of the house....so she can't close on Monday.

***We're now closing on Wednesday at 10am. We also need to be out of our co-op by 12 midnight..the same day. They are going to be moving on Monday and Tuesday...so that's why we couldn't close on Monday. F***ing people....Chat Icon

Well, the lawyer says he's going to call us tomorrow...and let us know for sure....but we need to be out by the 20th...or we start paying money to live in our own place.

Then you can do the same to her as long as it's in your contract. Do you have that clause where if she's not out by X date she must pay you rent?

I don't know why she should get to set the date of the closing - that is when it is.
In our contract it was in writing that if she stated past the closing date - she paid us $200 a day.
Is that in your contract?

Here's another question...

What if we tell our lawyer to tell their lawyer that if the closing isn't on Monday, we're backing out? Do you think it will push them to close on that day?

if you back out you lose your downpayment and it goes to the seller. thats not a smart move in my opinion. not sure what you put down but you lose all of it.

Did you have a set closing date in your contract - usually it says you have up to 30/45/60 days after the signing of the contract to close. If she is within the time frame she can push off the closing. What you can do is have your lawyer request that you close on Monday, but give her an extra couple of days to get her stuff out. My friend just did this - the closing needed to be on or before Dec. 2, but they were losing their mortgage rate on Nov. 18 so the woman they bought from closed on Nov. 17 and got her stuff out on Thanksgiving weekend. She also let my friend and her FH start working on the house right away.
Definitely talk to your lawyer about other options....Good luck!

ask your lawyer if you have a rent clause in your contract - like others have said. The sellers usually have 5 days after closing and then they start paying rent.


in theory you should lose your deposit if you back out, but our lawyer said that 95% of the time the deposit goes back to the buyers b/c no one wants to be caught up in litigation.

Check your contract...generally you have 30 days from the "on or about" date of the closing to actually close. After that time, you are well within your rights to have your attorney send a "time of the essence" letter - which means close on this day or give us our money back.

I am sure it will all work out- you are going to have to be all packed when you go to the closing-

maybe if you don't hire movers - can you rent a truck and have it packed and then go straight to the new place?

maybe you can pick it up this weekend and start packing it?

or even pick it up monday and start packing it?

it would be worth it to pay for a few extra days to not have to worry so much

I hate MOVING.

The people my parents bought their house from did the same thing. And then my parents were f*#&ed Chat Icon

Make sure to load the fridge with booze while you are moving in - you'll need it when you're done!

We rented the u-haul for Tuesday and then it will be packed for Wednesday.

That stinks!! You will totally be able to do it. We moved from our co-op with a TON of stuff. DH picked up the u-haul that morning with a friend, and moved everything by 5 or 6 that night. Its totally do-able. Good luck!
