eta - the guy claimed that he was inching up because he saw me inching and then his "brakes failed" and that's how he ended up hitting me. Trust me - he was not "inching up" as he claimed - there is FAR too much damage for what he claimed he was doing. idiot.  
Don't worry, it doesn't matter - he rearended you, he is completely at fault. No matter what his excuse may be.
