Leaving a job ?
So I have decided to leave my job and afraid they might make me leave before my two weeks. Would I still be entitled to be paid for those two weeks since it was their decision to terminate sooner?

If you give 2 weeks notice and they tell you to just leave now, I think you can collect unemployment... I have been researching unemployment myself bc my company appears to be shutting down due to financial constraints.

If you give 2 weeks notice and they walk you out right away? Then yes, they'll pay you out for the 2 weeks notice.

If you are an at will employee, they can terminate you whenever they want. You can quit whenever you want with or without notice. You are entitled to nothing. It's courteous and typically an accepted practice to pay you out but no law requires it.

Sadly they can ask you to leave instantly and not pay you for time unworked. Seems unbelievable that the commitment is only one way but it is how it is. Legally they do not have to keep you or pay you even if you give the courtesy of 2 weeks notice.

We had an employee who gave 2 weeks notice. During the first week of her notice she came late and left early and was just making her own schedule. She had already used all her sick personal and vacation days, so the time she was not there she was not paid.
When the 2nd week came and she was missing meetings and not tying up loose ends the manager told her she can just leave. Because we told her to leave and did not pay her the last few days of pay even though she had no more time left she ended up getting unemployment. It was so distracting to all the other employees who were coming in on time and she was just doing what she wanted we thought it was best she should leave.
I fought her unemployment all the way up to the highest level I could with NY state and she still got it. There was a hearing and because she lived out of state already she just has to call in and didn't have to show up in person.
It was a good lesson for us to learn about how unemployment works. I had so much documentation of her time sheets, all the emails she sent saying she was coming late and leaving early in the end it didn't help our case.
