Town of Hempstead Variance Process

Hello, we have applied for a permit on our home remodel/expansion and just found out it may take 4 months or longer to obtain because our project requires a variance. Has anyone else had this experience? Our contractor did not tell us it would take this long and because of the type of loan we are using to finance the project we may lose out on the interest rate we locked in and also the appraisal that we had to obtain (which is only valid for 4 months). According to the town it takes 6-8 weeks for the plan reviewer to make a decision (reject or approve) and if rejected another 6-8 weeks for the variance process. I've submitted a letter of hardship to try and expedite the process but I'm afraid it wont do any good. Your thoughts, comments are appreciated!

Find out why you need a variance and try to get the contractor to change the plans to something that doesn't require it.

You don't need variances for extensions by themselves. It's possible you are coming too close to the property line. You should find out the reason for needing the variance. I did a dormer and I was told I needed a variance for a second floor overhang. I ended up chopping off a foot off the overhang and I didn't need the variance and I saved a lot of money plus time and effort to get the variance.

I needed a variance for my extension, even though I maintained the same roof height as the original house, and the same fence offset as the original, but the rules changed since the house was first built.
I also needed a variance to keep the driveway as-is, since it was too big with the new rules, and since we were doing construction, it came under the new rules.
Sometimes you can't easily change the plans to avoid variances....

How long did the entire process take? Are you in the town of Hempstead? If so is this true "submit permit- permit gets rejected due to variance- file for variance, if it gets approved resubmit permit"?

That is how the process worked in brookhaven. it took abou three months to get our permit.

Definitely find out why you need the variance and see if it can be avoided. We knew from the get go why we needed one.
