Question about insurance/car accident

I was in a minor car accident a few weeks ago. My insurance (Geico) found the other party 100% at fault. So they are trying to get my deductible and their expenses back from the other insurance company. My question is - what if the other insurance company disagrees with Geico and does not find their driver 100% at fault? Is there a mediator that decides or does it go to small claims?

I would be surprised if they didn't agree with Geico but you never know.

Question about insurance/car accident

If the other insurance company does not find their driver at fault you may get stuck paying the deductible. This happen to DH last year.

Geico will typically file aribitration, if that other insurance company is a member of arbitration forum. Then it will go before a panel at a hearing, and a binding decision is made.

Question about insurance/car accident

My sister's bf was in a very minor fender bender in a parking lot. His ins. said it was 100% the other person's fault and the other person's insurance said it was I believe 90% the other person's fault 10% my sister's bf's fault. My sister's bf had to only pay a small fraction of the deductible.

That's probably what would happen here if they didn't find him 100% at fault, which again would be surprising, but you never know. I was also hit in a parking lot, backing up. I was already out and in the street, ready to shift into drive when someone backed up into me

Re: Question about insurance/car accident

I'm going through the same thing right now with Geico. They are fighting with the other guy's insurance for money. Geico said that most of the time they get all of the money, but on the off-chance that the don't, I'll lose my deductible but my insurance fees won't go up because Geico didn't find me at fault.
