keeping you guys posted**update** lawyer called with some news
if anyone still cares
so we got our dp check back and we started to look at new houses with same agent, but haven't found anything we both love.
Needless to say the day after chrsitmas we got a call they got their CO and they want to sell to us and they are sending our contracts that day.... we were SOOOOOOO excited!!!! i didn't post because I figured i would post the good news with a "we're in contract" post... but AGAIN it doesn't seem like its going to happen
I would love to say i can't take it anymore, because i really feel like I can't, but we need a place to live!!!
The hold up this time- they sent over a love note along with the contracts. If we make ANY changes to the contract at all, the seller will not sign them.
the issues with their contracts this time (which i would like to note, were not in the last set they issued to us that we canceled after waiting for them to sign for over a month, so why are they different this time is byond me)
A. it says we can't apply for an FHA/VA loan-our accepted offer INDICATES we are doing FHA!!!
B. the closing date is january 30!!! are they freaking kidding?? (i would love to close by then but I don't know how) I mean I know we have the "30" extra days but FHA can run 60 days, and who knows how long it will take for them to get them back to us since everything takes them weeks, so we still don't have 60 days even if we got them back by friday
and there are a few other little things that my lawyer likes to change like theirs say $100 for everyday past the 5 days they stay, my attorney likes it to say 250....
I want to I just don't know how i can do this anymore, but I can't give up, this is the ONLY house out of all the houses we have tried for that has our ENTIRE list of wants from both DH and I. I have given up on 6 other houses, and it really wasn't the end of the world because there was always something one of us didn't like or wanted to change, etc etc. this one has none of that!
My attorney called theirs yesterday and left another message to find out if they mean we can't add things to the contract, or if they mean we can't change anything. either way I think we will make our changes, send a DP check over and sign them and see where it goes.
I'm also thinking of writing that the check is void after 10 days from the date of issue on the actual check, so they can't drag us along much longer. If its over i want to know its over ASAP....
wish I had a better update, thanks for listening AGAIN I don't even want to tell my family again
**Update** my attorney called theirs and their attonrey insisted he put in the contract all the things he was supposed (allowing us to do FHA, etc etc) my attorney had to point out and READ to him how he didn't! he's changing it say exactly what we need it to say and sending over!!!! I'm hoping this is the final hump we have to tackle, but omehow I don't think so But at least its something in the right direction right??

You poor thing, I can't believe what these sellers are putting you through.
It really sounds like they don't want to sell the house. After stringing you along for so long, they send you a contract and say you're not allowed to change anything? Our lawyer and the sellers' lawyer went back and forth for 2 weeks, changing a word here and a line there. Apparently that's how it always goes. So they're basically saying, "you wanted a contract, here's a contract, but you're still not getting this house." But why? To what end? Are they hoping for more money? Or are they just really mean?

OMG Heather, I can't beleive the gall of these people!
Only you and DH know if you REALLY want this house. If you do, make the changes and see what happens, if not, I say put the void on the check and roll the dice. You've almost lost the house once before, so if it were me, Iw ould roll the dice.
Also, call your motgage person and see if anything has changed, maybe you can convert to a conventional loan. That might make the closing process easier. Either way, good luck!

I think if I were you I would just move on. What is with the games these people are playing??? They keep you waiting all this time and then want to close Jan 30! WTH Your house is out there, I say keep looking!

I haven't seen your previous posts about what sounds like your tedious process here so I don't know how far along you had gotten before the deal went south. I just wanted to say that the sellers are entirely unrealistic and irrational. They are telling you 1/30 and no FHA b/c it takes FOREVER to get the loan. I'm doing the closing for my friend on her house. The buyers are doing an FHA loan. We were supposed to close 10/15 but b/c FHA requires so many different criteria, etc. we STILL have not closed. We are hoping to close this month.
If you are the only potential buyers and have a pre-approval letter, the sellers are fools to not allow you to go through with the FHA loan. As much as it stinks, sometimes it's just not meant to be.

we did get a letter from the bank and we are the only ones i know about. and we have waited since october for them to get a CO!! they refused to sign the contracts then because they didn't want a line in the contract about having to leave $1,000 in escrow if their co didn't go through before we closed
had they signed the contracts and dragged their feet until they got the co, we would totally be able to close by now since we would have gone through the FHA process already which we did explain the them but they are nuts!! I wish we didn't love this house, so we could just easily walk away!!

I just wanted to give you my point of view because a very similar thing happened to us. We saw this house for the first time about 15 months ago. We put in an offer-didn't accept, we realized two months later to put in a higher offer because we loved it-they accepted-they kept cancelling the inspection-finally got the inspection -contracts sent out-they never signed them-this happened 3 times-finally about a month ago (about 14 months after we first saw the house) they signed the contracts and we are closing in a week. I felt like this was "our home", so we never gave up after so long-most people would have, but I am so glad we stuck it out-it all worked out in the end. I hope it works out for you too-there is hope!

thank goodness for you!! i hope this works out.
BTW- when i was buying this house, the sellers did not want to hear "FHA". my mortgage guy got on the phone when presenting our offer and assured the sellers that we will not have any issues. i think this is part of the reason i was clear to close within 30 days! it can go fast and good if you use the right people.
