fmla?
Can someone explain this to me. Is it 6 weeks natiral birth, 8 weeks c-section? I thoguht it was 12 weeks. So confused and when I do a search get such a mixed bag of info....anyone able to explain it in "real" terms. My husband is planning to take it when our baby comes.

FMLA is different than a maternity leave.
FMLA is time off given to you for the birth of a child (or adoption or to take care of a family member). It guarantees that your job will be there for you when you get back. You can take 12 weeks in a 12 month period (does not need to be consecutive). If you and your husband work at the same company, it is 12 weeks between the 2 of you.
Maternity leave is the paid leave that differs from company to company and you would need to talk to your HR department to find out what your company offers.

The six vs eight weeks is New York State short term disability payments. Those are considered the "standard" amounts of time a woman would be disabled following a birth that she may be entitled to payment (current amount up to $170 per week) from the state.
Totally different from FMLA, which is 12 weeks you are permitted to be absent from your job and your employer is required to hold open your job so long as you have worked for 12 consecutive months AND your employer has more than 50 employees.

all of the above is true, and i believe that the minimum leave is 12 weeks, but you also have the option of taking up to one year of FMLA leave. however, i am not sure of the circumstances in which you can extend your leave (and as the above posters stated, it's all unpaid).

I do not believe there is a law that states that you can extend your leave for a year. Is there a law or in a specific field?

This is not true. FMLA entitles an eligible employee up to 12 weeks of unpaid leave. Some employers (such as schools and the government) may allow employees to take a leave for up to 1 year, but this is at the employer's discretion and has nothing to do with FMLA.

ok that makes sense! i am sorry, i am just going by what i was told, but i do work for the government, so i must have gotten confused sorry for the misinformation!!
