Anyone buy with a foreign DH?
We were just talking about buying a co-op in NY the other day and DH seems to think it might be a problem since he is not a US resident/citizen. Would we have to wait until he got a green card?

You do have to be a permanent resident to buy property. Talk to a mortgage broker.

We're living in the UK right now. He has worked in the US before, for about 4 years, but was on a work visa at the time.
I think he's just worried about credit history and stuff like that affecting his status with a co-op board.

Well when you buy a co-op the application can just be made in one name and then you can list him as an occupant in the co-op.
If he is not financially contributing to the mortgage or earning money, it seems the co-op board would think that its a moot point. i.e. you can apply by yourself

You do not need a citizenship/green card to buy real estate in NY/US.
But what you need is a SSN....many "illegals" don't have papers but have a SSN...
My friend who is Greek has a SSN and no other "legal" papers (in process), he just bought a house in Astoria...they only asked for a copy of his driver license and the SSN...

You need to be a permanent resident with a SS to buy/get a mortgage.
It may be hard with his credit history. The one in the UK will not count even it has a major credit card like Visa or Mastercard.
I suggest for him to get a credit card right away after moving to the US. I found the easiest way to do is just open a secured credit card (you have a limit and the balance for the limit is in an account tied to it!). I was rejected MANY times so I just did that to build my credit. Soon after, I started to get CC offers.

I'm not 100% sure that residency is required. My parents bought a home in FL and do not have permanent residency in the US. They do, however, have SS #s and pay taxes. Maybe it's different in NY?
Wouldn't your DH have a credit history from living here for 4 years? I bought my first home when I had been in the US 3.5 years and had no problem getting a mortgage.

He has a SSN because he was being paid by a US company when he worked there, and yes, he did have credit cards, etc, so he does have a credit history - it's just not very extensive, and by the time we move back, he'll have been out of the US for 5+ years.
I don't think it will be a problem - and I didnt' think you'd have to be a permanent resident either (we bought an apartment here and I wasn't a permanent resident at the time). I think he's just worried about co-op boards turning us down...but I guess that's subjective anyway...
Oh, and Mel, we're in the beginning stages of hopefully setting down a timeline - which is further than I've ever gotten with him before - but no immediate plans at this point.

That should be fine then. They have no business asking for his immigration status since it's all about the $$$/mortgage. Otherwise, it would be discremination. If asked if he is legal. He just have to say yes.
