Need HR or Labor Law help
I am trying to find out if a person is Part time (24 hours/week) but salaried, are they entitled to be accruing paid time off at a pro-rated rate? It clearly says it is an exempt position if that matters. Any input is greatly appreciated. There seems to be no reference to this in the employee handbook, as all other PT positions the agency has have been hourly. Tx!

Re: Need HR or Labor Law help
First, as far as I am aware, an employer isn't required to give you paid time off for time not worked (outside of a collective bargaining agreement) with the exception of the NYC Paid Sick Leave Act (see info:http://www1.nyc.gov/site/dca/about/paid-sick-leave-law.page ) .
Second if this is NY State, they are required to have an established policy if they do have time off.
Under the New York State Labor Law, payment for time not actually worked is not required unless the employer has established a policy to grant such pay. Holidays, sick time and/or vacations fall under 'time not worked.' When an employer does decide to create a benefit policy, that employer is free to impose any conditions they choose.
Fringe benefits may include: Reimbursement of expenses or tuition Health coverage Payment for - Sick time - Vacation - Personal leave - Holidays
Also as an FYI - my company gives full benefits for part-timers that work a 3/5 work schedule. Anything believe 3/5ths gets no benefits.
