Former owner grieved taxes and.......
I just received a letter in the mail (addressed to him) stating that he won the grievance from 08/09 tax year. I guess he initially lost and then it went to a small claims proceedind and he eventally one......anyway, the taxes are being reduced close to 1000 and the letter states that he owes $504 and will be receiving a refund of $491 for taxes already paid.....so here are my questions.......didn't I pay the taxes for 08/09 if we closed on the house 10/3/07.....and isn't he still responsible for paying the attorney fee since he initiated the grievance long before I bought the house....and if I did pay the taxes that year is the town going to make out the refund check in his name because he grieved them?

You didnt necessarily pay the taxes at closing...you will have to check and see. Each bank is different on its requirements.
I would imagine being he is the one who grieved the taxes he is responsible for the legal bills. I would contac the town and let them know you purchased the house after tha taxes were grieved, etc.
If the grieved taxes are for a year you are owner of the house, I think you would get the refund. Again, something else you will have to discuss with the town.

Do you have a Real Estate Attorney? If so, I would call them and ask. If they won the case, it gets applied to last year and this year taxes I believe, so in reality it would effect you as well in the end (In a good way). I am just not sure about the cost and if the previous owner is liable or not. You can also try calling the company that actualy grieved the taxes and ask them.

Of course. That is why I am saying to call the grievance Company and explain the situation to them. The Tax credit goes to the current owner, so you might have to end up paying the cost now. It might be worth it to do so, since it's going to benefit you in the long run and it looks like the previous owner did the leg work for you.

IMO it actually sounds like a bogus letter.
Why would he greive taxes on a house for a year he didn't live in (08/09)
And why would he owe money to get money back??

the only time that you pay the grievance company is if you WIN... meaning they lower your taxes, then you have to pay ~ 50% of the amount that they cut down taxes for you...
it sounds right to me, and as a PP said, the previous owner did the legwork and you are reaping the benefits. BUT, before you pay anyone, obviously call teh grievance people to make sure it is legit. you could probably call the town too b/c they would have the corrected tax amount..

Not sure what the deal would be with that, but won't something about you opening someone else's mail come up?
I would definitely get legal advice to pursue this.

It's definitely legit....u could look it up on the TOH website under public inquiry....it is right there....says the grievance was won and a refund is being issued.
He actually did live in the house when he filed the grievance so who knows maybe he did it just in case the house didn't sell or maybe the house wan't even for sale at the point because you can grieve taxes from Jan to March..........We closed in Oct.

And if it was appealed, then he did way longer ago!

I was thinking about how to word that but geez......you moved two years ago ......forward your mail already...I'm tired of writing moved on it and sending it back.....this one however, really sparked my interest.
Hmmm.....just had a thought...I could say I saw it on TOH website because it does give the attorneys contact info.

You could just say, in regards to opening the mail, that you dont read all of your envelopes....who does? you were just going through a stack of mail opening it.

I agree. I work in an office and open the mail, and I can't tell you how many times I open another offices mail, and have to put it back in the envelope, and write sorry, delivered to wrong address. It happens to us too. I would just say you opened it without looking, but your sure glad you did
