Notice - Apartment
Our lease is not up until Oct 31st but we had two months of deposit that we had given two years ago when we moved in. Closing date is estimated to be Sept 1st but we would live until the end of Sept in apartment while we do some renovations.
IN our lease it does state deposit is not to be lived out, but this is a house and the owner (landlord) lives downstairs of us. I plan on asking her to ride out one months depo and get the second months depo when we move out because I think it is unrealistic for her to turn over 2,500 the day we move out. We will only be leaving one month early then our end date - is this horrible to do?
I am also thinking (husband disagrees) to tell her this weekend that we purchased a house and plan on leaving at the end of Sept. I figured the more notice the better this way we don't have to pay Aug/Sept's rent.

Re: Notice - Apartment
I wouldn't say anything about moving until the new place is a done deal....As far as the deposit,I wouldn't expect the LL to let you use it towards last months rent...If that is what your looking to do, I would speak to the LL and maybe they will agree to it....GL

Re: Notice - Apartment
I used my deposits in the past towards my last months rent but I asked the landlords first. They were both OK with it after I asked. They knew I wanted the deposit back and they did not really have the money to give it back to me so they agreed to it.

I am curious as to why you think it's unrealistic for the landlord to give your $2,500 back when you move out? Deposit money is supposed to be held in a separate or escrow account.
You can ask the landlord to live out a month's deposit, but I wouldn't expect the landlord to agree. They may or may not.

Re: Notice - Apartment
From my experience I do not think landlords hold that money when its a home, apartment building yes. But I could be wrong. All the apartments my husband rented never gave back the deposit and he was screwed and I guess that is why I am scared since it is a lot of money (to us.)
So when should I give notice then - when we have a secure closing date or when we close? I do not want to hold a mortgage and rent for two months (we simply can not afford it)

If a landlord did not give you the security deposit back, they are breaking the law and you can take them to court.
*When* you win... and I pretty much say when because I don't see how you would lose unless you destroyed the apartment... slap them with a judgement and stick a nice fat lien on the property. They will pay.
I wouldn't give notice until you have a mortgage committment (not a pre-approval) and are "clear to close". This usually happens 2 weeks or so before you actually close.

Re: Notice - Apartment
I would not give notice until you have a set closing date. We made that mistake and ended up not closing until THREE MONTHS later because of some crazy circumstances. Luckily we were able to stay (it was an apt. in a house), and he used our security as the last months rent. I'm thinking the landlord would prob prefer that so he doesn't have to come up with all that money, but I would def. wait until you have a set closing date, you never what could happen. Even if nothing comes up, the seller usually has 30 days after that on or about date to agree to close.

Re: Notice - Apartment
You can ask the LL to let you use the security for rent but they are screwing themselves and will probably say no. Alos it doesnt matter if its a home or building they still ahve to hold the money and not use it......legally it is not theirs to spend.
