FMLA question

At my current company I had to be at my job for one year to be
FMLA eligible.

I'm thinking about looking for a new job, but may become PG again soon... if I do will I be SOL when it comes to FMLA if I'm not there a year by law or is this a company to company thing? Has not being eligible affected anyone on here? I mean, I've never heard of anyone getting fired b/c they were home with their newborn, but could it happen if you aren't at your job a year?

From what I understand, you must be at the company for one year & it must employ over 50 people. Sorry.

They are only required to allow you 6-8 weeks of disability if you are not qualified under FMLA.

If you're there under 12 months (doe not have to be consecutive), worked less than 1,250 hours, you're out of luck.

We've had employees at my company who were not entitled to FMLA. They took their standard disability of 6-8 weeks (with less pay, as we only pay full disability for employees that are there over a year). After their disability was up, we allowed them an unpaid leave of absence for the additonal 4- 6 weeks (no more than 90 days).

They were technical & it was in our best interest to keep them. Depending on what your skills are, this may or may not be the case.

I have been with my company a little less than a year and they are not budging on anything. I get 6 weeks for vaginal and 8 weeks for c section.

What annoys me even more is two months after my leave i am eligable and can take FMLA before baby's first bday.
So, i asked them for an additional 4 weeks leave so i could take leave all together and it has been literally over a month since that and they are totally blowing me off. ( i told them i would sign a waiver stating i would not take FMLA if they were to work with me on this)

I got the corporate letter in addition to that stating they dont have to hold my job either and to contact HR after returing from leave.

Keep in mind i am ranked pretty well in the company, have great performance so far and am pretty unhappy with this. It is amazing how unfamily friendly some companies can be. I didnt realize how important this would be until now. I suppose my husband and I could live on one income, he does ok but i am so angry at how this has turned out that i almost dont want to go back just because no one even has had the respect to get back to me on any leave whether yes or no.

Thank you all for the info... well, I can't say that I will put off growing my family for a job, but it's good to know that my job doesn't have to be held... I personally refuse to go back after 6 or in my case since I had a c/s last time - 8 weeks to any job. No job is worth it. I want 12 weeks with my babies... not up for negotiation, if they don't like it, then I'm not the right employee for them. We'll see what happens, I may stay another year, it's just what stinks is that I'm a contract sales employee... my company's "real" employees get FOUR months maternity leave and then when they return they have the option of working 4 days a week for a few months. They get twice the PTO I get. So I wanted to look elsewhere b/c I'm getting the screws. Oh well, not putting off my family. Again, I appreciate the info....

who are you in contract sales with?
Medical business? I work for a major medical company and it is amazing how much they are not budging with me. It really makes me question too going back bc it makes me so mad.
All i am asking for is an extra month in addition to the 6 weeks, i just think it is awful.

This is my first baby so i have no idea how i am going to feel once i hold my baby. I will probably never want to go back, lol, esp when they dont work with you!
