What would you do?
What would you do...
...if you came out of a store and while you were loading things into the car, you notice that the car parked next to you, has someone sitting in the driver seat drinking a beer?
You are not sure if the car is running?
You are not sure if this person is getting ready to start their shift at one of the stores located in this parking lot.
You are not even sure what they were doing there.
You are not sure how much this person has had to drink.
The only thing you do know is that they were sitting in a car drinking a beer.
What would you do?

I'd take notice of the exact model & color of the car, to memorize the license plate if possible, get in my car & leave the parking lot & call the cops. The police rely on tips from civilians to help enforce the law.

But it's not illegal to drink nor is it illegal to drive....illegal to drink & drive and it's illegal to have an open container...
If they're not driving...I'd mind my own business and not make assumptions....

I agree too, I would probably have gotten their license plate number and called 911 as i pulled away, but I would not have stuck around to see what happened

ITA! They weren't doing anything wrong at that point... I can sit in my car and drink an entire case of beer if I want. As long as I don't drive away....

same here. If I had DD with me, I'd probably try to get out there as quick as possible, but I guess I'd do that anyway. I'd just be more nervous with DD around, so I'd get her in my car right away rather than let her sit in the cart while I unloaded.

I would do the same thing. It's for everyone's safety. He might not hit you the moment he decides to leave that parking lot but it could be someone else. Driving a car is a privilege, if your not responsible enough to maintain that privilege you shouldn't be driving.

If the keys are in the ignition, whether the car is on or not, then it IS illegal, especially if they are in the driver's side. The intent is that you most likely will drive. I know this b/c i'm a police officer in the city, and if you are in the driver's side, with keys in the ignition, and have an open container, that's enough to get arrested. But will I call the cops in this situation? Personally, no

I wouldn't let it go.
I would either do as Kelly said and call the cops once leaving
OR
I would go back into teh store if they had a security guard, and ask them to check it out.
b/c I don't know for certain it's the last in a six pack and he/she is about to turn the ignition, I can't turn a blind eye. I would be sick with guilt if this person harmed someone if a simple phone call could have prevented it.

Interesting. Knowing it's illegal, you still wouldn't call? As a cop, would you want someone to call about this, or would you think they were overreacting?

Is being inside of a car drinking considered a violation of an open container law? If so, then wouldnt the person drinking be doing something illegal? The car is not really an extension of a home or a legal drinking establishment. Just asking.

i would take down the license plate # and call the police. better safe than sorry. they weren't parked outside their home - they were parked outside a store. my assumption (however wrong it may be) would be that they are not staying there, and moving on, most likely by driving. i will say it again - BETTER SAFE THAN SORRY. what if he drove and hit someone and killed them? the guilt i would feel would be so immense.
